@rwesthead Gang sexual assault with the 14 year max entitles the accused to a preliminary inquiry. That means the victim has to testify in court an extra time. They're often avoided for that reason in cases like this where the accused won't be facing anywhere near the max anyways.

@nationalpost This is just a terrible and wrong take. The confusion was about the word "a" not "woman". The trial judge mistakenly focused on whether *a* woman would be aware of being penetrated instead of whether *the* woman who was the victim here would have been aware of it.

@profbenperrin Yeah he does. Well, Mendicino actually, but once it's in the control of cabinet it's in control of the PM. It's under s.6. There are good reasons why he shouldn't (e.g. political interference in the administration of justice) but he clearly has the statutory power.

@TheTorontoSun Drug impaired *charges*. When MJ was legalized they also brought in easier to prove drug-driving offences, increased police powers and spent significant $$ on investigative tools and DRE training. This doesn't suggest at all that there is an increase in drug impaired driving.

@MarcLevesqueEco He commented a few minutes ago. I'm not one to defend Singh, but I'd want to know if he was at home in his riding before casting too much judgment. Him commenting at 8:20am local time is quite different than waiting until 11:20am local time.
