@MatthewSitman
@jaywillis
The fact that Ginny Thomas has for yrs. been running & maintaining an email listserv made up of her husband's former law clerks might also suggest that the wall of separation b/w her private polit. activities & his professional duties is a tad bit porous.
@NormOrnstein
@hugolowell
I totally get the whole "every defendant deserves a lawyer" principle, but is it not a little icky that so many former DOJ prosecutors go on to have careers in private practice defending ultra-wealthy white-collar criminals against prosecution BY the DOJ? /1
@stevesilberman
There is something extraordinarily f’d up about the fact that so many of these crucial facts are being revealed in books that are earning their authors millions of $ — instead of in public Congressional hearings or courtrooms.
Serious question. Even IF Biden wins by a huge margin in Nov., why would any MAGA GOP Senators or House members NOT attempt another coup? They've faced NO legal consequences for the first one. On the contrary, many have been re-elected once & are on track to be re-elected AGAIN.
@FPWellman
Given that it's taken Fulton Co (to say nothing of DOJ) more than a yr. to get serious @ investigating a textbook-perfect case of election tampering committed by the former Pres. w/ multiple witnesses & a crisp, hr.-long audio recording, I doubt these guys have much to worry @.
@FPWellman

Whether it be the military (Greitens, Flynn), medicine (Jackson, Conley, Atlas), or law (Barr, Clarke, Gaetz), what's become apparent is that the entities tasked w/ enforcing occupational ethics & discipline are functionally worthless when dealing w/ the politically-connected.
@duty2warn
Remember that two days later, Ravnsborg got a text from a political consultant saying, “At least the guy was a Democrat.” These are the kinds of people we’re dealing with.

It’s SO refreshing to have a Dem candidate for higher office know how to actually throw a few punches. His People “Welcome to my crib” ad from last week was scalding. Love it!

As a general rule of thumb, celebrity TV doctors with over $100 million in asset$ + several properties NOT IN PA don’t usually fight for working people. 🙃
@tribelaw
Yes, it's great that Smith replied "within hrs." But doesn't the fact that commentators are impressed by this just speak to how completely inadequate & disgraceful Garland's handling of Trump was for the past 20+ months? Imagine if we'd had somebody like Smith from day one.
@richsignorelli
@donwinslow
I know many disagree, but I think if Garland had IMMEDIATELY & AGGRESSIVELY gone after Trump & his inner circle in the first 1-2 months after he was sworn in & the America people saw swift & severe repercussions for their traitorous acts, we’d be in a different world today. 😢

I want to thank Rubio & Grassley for enlightening me about how much of a sacrifice it is to be a sitting United States Senator. I always assumed it was a relatively cushy job but now I see just how incredibly hard it is.

posted this tragically prescient tweet. To those who say Biden’s accomplishments w/ a 50-50 Snte are amazing, how would you have felt on 1/7/21 if you had been informed that 16 mos. later NONE of the following would have happened?
* Garland won't release the memo on Trump and obstruction
* Yellen won't release Trump's tax returns
* Wray won't investigate the elites behind the attempted coup
* Biden won't restructure board to get rid of DeJoy
* Dems won't pass voting rights
You catching on yet?
@marceelias
To those Dems who breathlessly praise
@AdamKinzinger
as a heroic savior of democracy, just listen to him explain to
@SykesCharlie
on the Bulwark podcast how the John Lewis VRA is "a civil rights era construct" that "has to go away." (go to 30:00 mark)
@donwinslow
Reminds me of this tweet from just over 10 months ago from
@sarahkendzior
. The fact that it was true then was an outrage. The fact that it’s still true today is reprehensible & a searing indictment of our political & legal institutions & leaders.
* Garland won't release the memo on Trump and obstruction
* Yellen won't release Trump's tax returns
* Wray won't investigate the elites behind the attempted coup
* Biden won't restructure board to get rid of DeJoy
* Dems won't pass voting rights

op-ed as he brutally rips our destructive, disgraceful, & pathetic AG Merrick Garland a new one. My response? Elie is far too easy on him. 😉
I hope after the Hur fiasco, even Merrick Garland's ardent defenders can see that the dude has got to go. His commitment to being "apolitical" has led to some desperately political decisions.
My breakdown of his greatest flaws in
@thenation
@TimFullerton
@nycsouthpaw
An even more pertinent question — why did Biden recently appoint Derek Kan, a dyed-in-the-wool GOPer who worked as an advisor to McConnell — to the USPS Brd, thereby virt. guaranteeing DeJoy will remain postmaster general for another yr. & likely longer?
@BillKristol
Even if Trump's indicted tomorrow, Garland's *already* set a horrifying precedent for all aspiring GOP autocrats. Even if you're the most transparently criminal, corrupt, & traitorous president imaginable, you get AT LEAST 2 yrs. of legal impunity after leaving office.
@djrothkopf
Garland may achieve his goal of restoring the "nonpartisan" reputation of the DOJ. The problem is that in the process he's rapidly extinguishing the already-diminutive faith the public retains that we have even a remotely functioning system of justice in this country.
AG Garland on Uvalde report: "It is now widely understood by law enforcement agencies that in active shooter incidents, time is not on the side of law enforcement. Every second counts. And the priority of law enforcement must be to immediately enter the room & stop the shooter."
If this was the inside job it appears to have been, I predict we’ll see some federal criminal trials of expelled Members of Congress for “seditious conspiracy” in violation of 18 U.S. Code § 2384 before 2022. The penalty is 20 years in prison. Watch this space.
@editwest
@tribelaw
Also remember that just 1 wk before this call Trump explicitly told the acting AG to, "Just say that the election was corrupt & leave the rest to me and the [GOP] Cngrssmen." This should have shut the door on the ludicrous "intent" debate nearly a yr. ago.
“DOJ failed to take immediate and strong action, and [x] has now become just another ordinary event” is a perfect encapsulation of Garland’s tenure as AG.
@stevesilberman
So it only took a little over 13 months for this super basic fact to come out! Maybe in another few yrs. we’ll get an actual tax return? And I can’t wait for all the cool stuff we’re gonna learn about in 5/10/20 yrs! (assuming we’re even a semblance of a democracy at that pt).
On anniversary of OKC bombing,
@JeffreyToobin
writes about how the attack shaped Merrick Garland. Toobin’s new book, Homegrown, is a must-read for DOJ insiders and those who study domestic terrorism. Garland gets it. Justice is coming.
@AWeissmann_
Why does Garland ALWAYS escape the wrath of prominent former DOJers & legal elites? Yes, Barr was awful. Yes, Cannon’s decision is horrendous. Yes, Durham is a disgrace. But the AG w/ the power to end this nightmare NOW is Garland! Where is the accountability for him?
@NormOrnstein
@hugolowell
It just seems like those defendants have an unfair advantage by having attorneys who know exactly the most effective arguments to make against other attorneys who used to be their colleagues. I know -- the legal system is rigged for the wealthy. It's just so blatant at times. /2
Nessel referred the fake electors case to DOJ in Jan. 2022. After seeing no signs they were seriously looking into it, she reopened it this Jan. It took her 6 mos. to bring charges. Why wasn't Garland able to secure ONE indictment during his 28 mos. as AG?
“If Ms. Nessel can move against these individuals in Michigan, Mr. Smith can and should do the same against the ringleaders. Together, they can hold both the foot soldiers and their organizers accountable for their actions leading up to the Capitol riot.”
@MarkJacob16
If you're supporting a candidate for U.S. Senate and asked to respond to allegations that said candidate threatened to blow a former romantic partner's brains out, maybe it's not such a great sign if you have to say, "which one?"
@duty2warn
Folks in DC sure seem to get "blown away" by their friends & colleagues a lot. Maybe we should be a little more skeptical when they assure us, "I KNOW (blank) & (blank) is a good, decent, honorable (man/woman) of the utmost integrity who I trust will do the right thing."
The facts in this tweet are true. All these phones/emails WERE seized under Garland pre-Smith. What's not mentioned though is that most (if not all) were seized over a year AFTER Garland was sworn in as AG. Apparently many find that timeline acceptable. To me it's indefensible.

will see this or -- even if she did -- care. But I'm going to pour my heart out here anyway as if she were listening. I'm probably one of the few non-Arizonans who knew who you were in the mid-2000's.
But it's NOT only "up to us," Glenn. "We the people" don’t have the power to indict seditionist political leaders. Even if we outvote them again, why WOULDN'T they incite another violent coup attempt? It's not like they faced consequences for the last one.
Saving democracy has always been up to us. And we’ve always been up to the challenge. The forces of autocracy - as personified by a self-proclaimed day-one-dictator - will not win. Not here. Not now. Not ever.
Jared Kushner says Gaza’s ‘waterfront property could be very valuable’ | The Guardian
This is the GOP alternative to Biden on Gaza in November. Sheesh.
Even more than the fact that the Biden admin. hasn’t so much as lifted a finger to get rid of DeJoy, what bothers me even more is that they haven’t felt the need to give their supporters ANY explanation as to WHY. Their arrogance is simply breathtaking.
DeJoy is in control of the USPS, so expect the USPS to work the absolute worst during the election to hurt Dems.
Vote by mail ballot, but if you can, DROP the ballot off in person.
Reduce strain on the system. Avoid mailing things from October through the election.
@JoyceWhiteVance
“Obstruction is a crime?” Really? Tell that to Garland, who let the statute of limitations run out on the multiple obstruction counts meticulously documented in the Mueller Report.
@donwinslow
Just a reminder that if Cheney had been President instead of Trump, each of the horrifying SCOTUS rulings the past four weeks would've likely have been the same.
Something I'll never understand is how pro-democracy commentators I deeply respect can express horror & disgust at the crimes GOP elites have committed in broad daylight whilst failing to condemn the man who could've held them accountable but didn't.
Never forget that Ron DeSantis kidnapped Venezuelan’s, fleeing, the brutal Maduro, and seeking asylum, taking them illegally out of Texas, forcing them to Florida, and then sending them on a private plane to Martha’s Vineyard. He should be charged with human trafficking.
@benFranklin2018
It's truly depressing that
@sarahkendzior
's tweet from >9 mnths ago remains 100% relevant today. I really thought the Biden admin. would make sure to accomplish at least ONE of these goals, if for no other reason than to quiet their critics. But nope.
* Garland won't release the memo on Trump and obstruction
* Yellen won't release Trump's tax returns
* Wray won't investigate the elites behind the attempted coup
* Biden won't restructure board to get rid of DeJoy
* Dems won't pass voting rights

W/ all due respect, what makes you so sure Dearie will do the right thing? I get that you know him personally & think he’s been a deeply honorable & fair judge. But if “me, too” & the Trump era have taught us anything, it’s that yesterday’s hero can easily be tomorrow’s monster.
I know the reaction of many to this report will be gleeful crowing about how totally f**ked Trump is. Mine is quite different — absolute horror that DOJ has been THIS inept & slow at taking down the dumbest, least discrete cadre of criminals imaginable.
Wow.
Trump and his aides also allegedly carried out a “dress rehearsal” for moving sensitive papers even before his office received the May 2022 subpoena.
Trump workers moved Mar-a-Lago boxes a day before Justice Dept. came for documents
@AWeissmann_
It's supremely depressing to see legal elites again & again misunderstand the enemy they're fighting & the terrain on which the battle is being waged. How many times do they need to get outplayed & outmaneuvered before they figure out their traditional tactics aren't working?
@SIfill_
@barney1776
It’s surreal listening to the nation’s top journalists, commentators, legal experts, etc., struggle mightily to solve the “Why did he take classified docs?” Rubik’s cube. Was he a hoarder? Did he just want some rad mementos? Etc. The lvl of denial is extraordinary — & terrifying.
@sarahkendzior
THIS. I keep hearing, "If Trump's indicted, it'll show nobody's above the law." NO! The fact that a coup-inciting treasonous madman has gone 20 mos. w/out criminal accountability actually proves the opposite! The next GOP pres. who has a shred of discretion WILL be untouchable!
Spoiler: Nearly 4 yrs. after this exchange b/w
@NormOrnstein
&
@DavidCornDC
, Garland's DOJ has prosecuted NONE of these people for lying to Cngrss. Not Bannon. Not Jr. Not Kushner. Not Hicks. Not Prince. I ask again -- why would they not do it all again? Where is the deterrence?
@MarkJacob16
Very reminiscent of when Stephen Miller — who was largely responsible for Trump’s “rip kids from their parents & put them in cages” immigration policy (some of whom STILL haven’t been reunited w/ their parents after 4 yrs.) — showed off his newborn baby.
Here's just a sampling of the Trump-era criminals who haven't been held accountable for ANYTHING in Garland's DOJ:
•Jared
•Ivanka
•Don Jr.
•Guillfoyl
•Lara
•Giuliani
•Meadows
•Flynn (for his post-pardon crimes)
•Manafort (his pardon was narrow)
1/
I feel like the Justice Department completely forgot about the Republican members of Congress who sought pardons for their role in the deadly Insurrection.
Somehow I don't think it's helpful to call 10s of 1,000s of Michiganders "terrorists" for simply leveraging their sacred right to vote in an effort to put pressure on Biden to stop giving Israel unconditional military aid to slaughter Palestinian children.
@tribelaw
Even IF Garland indicts Trump immediately after the mid-terms, what do we do the next time we have a Republican authoritarian president who has a scintilla of intelligence & discretion & DOESN’T committ &/or confess to his crimes on nat’l TV every few days?
@NormOrnstein
@AshleyRParker
@tylerpager
@ColbyItkowitz
9 yrs. ago, Manchin wept w/ parents of Sandy Hook victims & proclaimed, "I can do something." Then, when his & Toomey's bkgrnd check bill died via filibuster on a 54-46 vote, he refused to give up, stating, "We’re going to pass this." He never did. So whose fault is it? BIDEN's!
Strange how DOJ alum pundits are apparently far more willing to call on a local DA to step down from a case for dating a coworker than they are to demand our AG resign for not investigating the plotters of America's first deadly coup attempt for ~1.5 yrs.
For the good of the case, given that ethics issues will abound now as to Willis, she should voluntarily recuse herself from the case and allow another prosecutor to oversee the GA trump case.
@imillhiser
It's pretty astonishing how over the period of @ 6 yrs. the question shifted from, "Is it really possible that we could lose our democracy?" to, "Is it really possible that we can save it?"
“My problem is with Garland and his signature move of convincing Democratic presidents that his ability to be inoffensive to Republicans is a virtue instead of a moral failure.”
-Elie Mystal, 6/21/23
@NormOrnstein
So why hasn’t DOJ taken any action or Garland at least issued a public stmt? And speaking of FL, why hasn’t DOJ taken any action or Garland issued a public stmt about the fact that FL didn’t allow DOJ election observers into voting locations last Nov.? 1/
Florida and Missouri likely impeded the protection of federal voting rights during the 2022 election, and then failed to release their records about it.
So we sued:
@AWeissmann_
Really respect
@AWeissmann_
but I find this tendency of legal elites to assure us somebody definitively *IS* honorable, apolitical, fair, etc. based on their & others' personal experiences w/ that indiv. to be a little naive & presumptuous, esp. in the age of Durham, Barr, etc.
@AWeissmann_
There's been a lot of mockery lately of Trump's inept & chaotic legal strategies. But given the fact that such strategies have WORKED for yrs. & yrs. (as demonstrated by the fact he's STILL not in jail), maybe legal experts should consider the possibility that the joke's on them?
@robreiner
"We risk going the way of Brazil?" I think you mean, "Brazil risks going the way of the United States." They're just 2 yrs. behind us. The difference is they're actually arresting the rioters (HUNDREDS of them) rather than letting them just walk away.
Interestingly, Garland's DOJ apparently has no fear whatsoever of "administering justice" to prominent Black politicos who happen to be DEMOCRATS -- even when DOJ can't get a jury to convict (Gillum), the charges are dismissed by a judge (Benjamin), etc.
John Roberts and the other justices have made a mockery if the notion of equal justice under the law. Ignoring and justifying Thomas’s criminal behavior. But so has Garland’s DOJ. Justice is to be administered without fear or favor. Not in this case.
@imillhiser
Amen! THIS is the kind of drastic action that’s been missing! How refreshing after the last 6 years of those w/ crucial inside info refusing to share it to warn the public when they had the chance & instead just staying quiet or releasing a book years later.
@richsignorelli
@MichaelCohen212
@lauferlaw
@ejeancarroll
I’m still furious that DOJ took that stance in the

🚨BREAKING NEWS -- THE JUSTICE DEPARTMENT is conducting a criminal probe into
@CoriBush
, according to six sources familiar with the investigation.
The Justice Department subpoenaed the House Sergeant at Arms for records relating to the misspending of federal security money.
@donwinslow
Is it even possible to break fed. election law more definitively & blatantly than Trump did in the GA call? Esp. combined w/ his demand to Rosen & Donoghue days earlier to "just say the election was corrupt," what addit. evidence could possibly be needed?
@ThePlumLineGS
@AshaRangappa_
Maybe this is a naive question, but isn’t this the sort of thing DOJ should have already done months ago if it was investigating 1/6 seriously? Is it possible DOJ already has all this info but is keeping it to themselves? If so, would Congress just be duplicating their work?
I not only blame Garland, Monaco, etc. for the staggering & very possibly fatal damage their breathtaking dereliction of duty inflicted on our democracy. I blame the myriad legal, political, & media elites who refused to speak out.

It’s stunning to think how competently & efficiently our govn’t could be run if every committee were composed of 77% serious Democrats & 23% non-insane Republicans.
If Garland thought it was fine DOJ hadn't interviewed Raffensperger or Ducey about the 2020 election during his entire first 2 yrs. as AG, he wasn't being "meticulous"; he was being breathtakingly derelict in his duties. He MUST resign or be fired NOW.

Wake up!!
Yes, yes, I know you want to go back to seepies.
What? You need your blankie? Okay — but if I bring you your blankie, do you promise to at least take a look at this clip of Lev Parnas testifying?
@JoyceWhiteVance
So up until now his conduct HASN’T been “so egregious that DOJ will have to indict?” I’m sure DeSantis, Cruz, etc. are happy to know that a GOP pres. has to color MILES outside of the lines of the law before there’s even a CHANCE they’ll be indicted YRS later. Deterrence, right!?
@NormOrnstein
Is there ever a pt at which you’ll say something like, “I’ve tried to avoid publicly criticizing Garland because he’s a dear friend. But I simply can’t stay silent any longer. His decis. to allow such flagrant, traitorous criminality to go unpunished for so long is indefensible.”
@duty2warn
This era has taught young & aspiring GOP politicians some very valuable lessons.
1. Obstructing justice works & won't be prosecuted
2. Destroying evidence works & won't be prosecuted
3. Witness tampering works & won't be prosecuted
4. Perjury works & won't be prosecuted
[1 of 94]
Yes. But the real story should be why >1,167 days have passed since Stone said this & DOJ still hasn’t indicted him — for this or anything else. (And no, it’s NOT because Trump pardoned him. His pardon was narrow in scope.)
@maddow
Funny — I used to think perjury was a really serious accusation. Little did I realize that it would become an essential rite of passage for anyone nominated to serve in GOP presidential administrations.
.
@tribelaw
's evolution on Garland:
•1/6/21: "[He] will be one of the greatest [AGs] in...history"
•11/14/22: "I know...[he] will do the right thing"
•Today: "It’s as though...[he] doesn’t give a shit"
3 words I've never seen Tribe say: I WAS WRONG.
DOJ got a guilty plea out of former Trump lawyer Michael Cohen but opted not to pursue a criminal case against the former president for election interference. Strike One for SDNY. Then DOJ waited till now to release records from that old case to haunt Manhattan DA Alvin Bragg.
@BarbMcQuade
I understand (though disagree) w/ this argument as it relates to 1/6. But can you explain how this applies to:
-Cohen “Indiv. 1” case
-Mueller’s obstruction counts
-Trump’s GA SOS call (which is just as much a federal crime as a state crime)
-Bribing/extorting Zelensky
-Etc.
@tomwatson
Agree this is despicable. But can we also please forever banish Bob Woodward from civilized life for not warning the public that Trump was privately telling him COVID was far deadlier than the flu while publicly claiming it was no biggie & would disappear?
There is no ethical or moral defense of Woodward's decision to not publish these tapes as soon as they were made. If there was any chance it could save a single life, he was obligated to do so. Bob Woodward put making money over his moral and professional duty.
Sadly true. A tragically weak Attorney General pitted against the most dangerous coup attempt in our entire history. Garland is a nice, smart and principled man but one wholly unsuited to his job. I plead guilty for having overestimated him massively.
@NormOrnstein
@harrylitman
Future historians will look back & be absolutely perplexed that today's "institutionalists" were far more concerned w/ preserving OLC memos, the filibuster, 9 seats on SCOTUS, etc. (NONE of which are in the Constit.) than voting rights, = justice under the law, etc. (which ARE).
@AWeissmann_
Can I just say it’s AWESOME to have
@AWeissmann_
so active on Twitter recently. I get sad when he disappears online for big stretches of time but try to reassure myself that might mean he’s helping out DOJ or other prosecutors on important cases that he has to keep quiet. 😉
@caslernoel
@gwenmcm14353560
When people say Trump has been getting away w/ the same crap for FIFTY years, they aren’t exaggerating (well, maybe by a year).
@AWeissmann_
The fact that this “stratagem” has worked for Trump for ~50 yrs. is a damning indictment of our justice system. You shouldn’t have to incite a deadly coup attempt & steal nuclear secrets & documents w/ info on human intelligence sources to ping the radar of investigators.
@AWeissmann_
THANK YOU for being willing to puncture the “nearly everyone at DOJ is a decent, honorable, 100% apolitical actor (except for Barr & Clark)” narrative promoted by many former DOJers. What we saw at DOJ under Trump **never** would’ve gotten to this pt. if this had been the case.
Isn’t it weird that DOJ has indicted Hunter for tax evasion & gotten the max. prison sentence for the guy who leaked some rich peoples’ tax returns, but it has’t brought a single tax charge against Trump despite gobs of public evidence of his tax crimes?🤔
NEW: A footnote tucked into a court letter suggests that Trump lied to the government for years about a mysterious $50 million loan that apparently never existed—a lie that tax experts said suggests potentially major tax evasion. ME
@thedailybeast
@richsignorelli
@60Minutes
Remember it took DOJ until April of THIS YEAR to get Mark Meadows’ phone records — 13 MONTHS after Garland had been AG. And Garland defenders like to point to that as evidence he was “on top of it” all along. Unreal.
@Angry_Staffer
People had the same reaction when the Trump admin released the transcript of TFG’s “perfect call” w/ Zelenskyy in 2019. “Why would they release this!? It’s so damning!” Three years later, Trump has faced zero legal accountability for that call. So who got the last laugh?
