One of the metrics I use to know whether I’m helping defend speech in a principled and thoroughly non-partisan way, is whether I get repeatedly called both a right winger and a communist on the same day. By that measure, it’s another solid week in the books.

Columbia closing its entire campus to the public over safety concerns about growing Middle East protest is incredibly unusual. Trying to think of a precedent. I can't recall one.

@jgrantaddison Oh, no. They've put a lot of thought into their rule that says wishing harm on people is banned — unless they're subjectively ok with whom you're wishing harm on. Wild.

In 24 hrs. I’ve been asked why we defend “only Satanists & drag queens” & also why we want campuses to be “havens for only white Christians.” Practice for if I end up in front of Satan or Jesus someday and they’ve got similar questions? Ghost of Lenny Bruce, hear our prayer.

Penn's faculty senate says academic freedom and free speech are THE most important things — which must mean they're finally gonna go to bat for Amy Wax! Surely the months-long investigation into her speech will wrap in her favor any minute now.

If cancelled over pushback, this is bad. @UChicago is one of the best schools in the nation for free speech where “[I]t is not the proper role of the University to attempt to shield individuals from ideas and opinions they find unwelcome, disagreeable, or even deeply offensive.”

UPDATE: @UChicago has just CANCELLED “The Problem of Whiteness” class. Thank you to everyone who shared my thread. We are obviously fighting an uphill battle, but this is a huge victory. Students need to call out anti-white hatred whenever they see it. Just the beginning.

Is “There are 2 genders.” “proxy” for trans genocide? Is “Women need the right to choose.” “proxy” for genocide of the unborn? Is an IDF official speaking on campus defending the war in Gaza “proxy” for genocide of Palestinians? Some admins. will think so and censor accordingly.

"Who knows?" (!?) Stanford, for one, has clear policies that students agree to follow. There's also California's Leonard Law and a century of First Amendment jurisprudence informing these concepts. This is well-settled law that elite @StanfordLaw students certainly should know.

Stanford Dean Martinez faced protesters and this white board when teaching her con law class. Here’s the thing: we are light years away from a coherent theory of free speech on campus. Who has the right? The students, the faculty, the administration? All the above? Who knows?

But remember, in limited public forums, the host sets the limits. So back to Chemerinsky's garden: even if there was evidence this was a school-sponsored event and thereby a limited public forum for speech, Chemerinsky still decides who can speak and on what topics.

Penn @Wharton ’s resolution to ban even “veiled” hate/violent speech and advocacy of murder/genocide will have unintended consequences. Similarly vague/overbroad policies are abused every single day on campuses nationwide. They’re written in a way that makes abuse *inevitable.*
