Here is a clip from that night outside the Capitol, showing Rep. Boebert running up the stairs as though she was trying to make the vote, and me telling her that it had closed already.
*running up steps*
Me: They closed it.
Boebert: They closed it?
*keeps running*
Call it a protest — there’s absolutely no way to ever justify adding another $4-6 trillion in debt.
This is more DC self-created garbage that I will always fight against.
Collins defends KBJ against Republican criticism that she is soft on crime to me this morning: “I don't think the Fraternal Order of Police would have been endorsed a candidate that was soft on crime.”
I asked Manchin this morning if he would support a quick confirmation process for the next SCOTUS nominee. "I want to make sure we don’t have a vacancy there for any time at all. So, yes absolutely, let’s move forward. A lot of the people have been vetted," he said.
Cheney indicates to
@mkraju
that Minority Leader McCarthy should not become speaker should Republicans take the majority, as he should not be third in line to the Presidency, given his rhetoric surrounding January 6th.
Pelosi “could call for hearings in the House with a majority of the members being Democrats with full subpoena power with the agenda being determined by the democrats, but that’s not the path we have chosen to go.”
“I don’t want to,” but “if they don’t want to do this, we will”

Romney explains supporting KBJ for SCOTUS and not District Court: "I was concerned that she was outside the mainstream. And as a result of our meeting for an hour together and reviewing her testimony before Congress, I became convinced that she's within the mainstream."
Additionally, Rep. Boebert entered a statement into the congressional record after the vote closed, saying that she was "unavoidably detained" and "would have voted no"
If working on the Hill prepares you for nothing else, it does prepare you to go through security at the airport without accidentally setting off the mags
Sen. Hirono, asked by
@mkraju
what Democrats could have done differently before Election Day: “My goal has always been to communicate to to the American public who is actually screwing them over, and it's not the Democrats.”
McConnell declines to comment on FBI executing a search warrant at Mar-a-Lago, during a press conference on flood recovery in Kentucky. "I’m here today to talk about the flood and the recovery from the flood," he said.
Pelosi, when asked if Republicans are afraid of McCarthy or Trump subpoena: “it sounds like they are afraid of the truth and that’s most unfortunate. But hopefully they’ll get used to the idea that the American people want us to find the truth, and that is what we intend to do.”

Schumer told me "no," there are no concerns about Sen. Fetterman being unable to finish his term. "We expect him to be back soon, and wish him and his family the best."
Pelosi tells reporters “yes,” she is confident House Dems have the votes to pass BBB tonight.
I asked if she was concerned about moderates. She said, “we’re bringing a bill to the floor to vote for the people, for the children, the President’s vision. We’ll see what people do.”
Clyburn praises Biden for “keeping that promise” to nominate a Black woman to the Supreme Court, and says he supports Jackson’s nomination, though he has put Child’s name forward.
“She is outstanding, she will make a great member of the Supreme Court,” he said.
Best pool report from Hill pool producer
@cbszak
: Senators have not stopped at the pool cam. But this dog was just following Sen.
@MikeCrapo
down the entire hallway. Sen. Crapo said it’s not his dog. The dog proceeded to go into the hearing room and lie down under the table.
Capitol Police have arrested around 30 voting rights protestors and hunger strikers, who breached the plaza and sat on the Senate steps singing “go tell Sinema we shall not be moved,” “go tell Manchin,” and “ain’t gonna let McConnell turn me around.”
Pelosi tells
@seungminkim
that reports of the programs in the Build Back Better package being dramatically scaled back were “news to me”
When it was pointed out that this was discussed in yesterday’s meetings at the White House, she said “That’s not a decision.”
Pelosi on House Dems criticizing Manchin and Sinema: "I have discouraged people from making comments about them," saying that they "have to be respectful."
She added, "I don't think there's any upside in Democrats criticizing Democrats."
More from Cheney, on McCarthy:
“I wish that he were a brave and honorable man. He's clearly trying to cover up what happened. He has an obligation to come forward and we'll get to the truth.”
Liz Cheney does not rule out a subpoena for Leader McCarthy after he said he would not cooperate with the select committee.
“We’re gonna evaluate our options, but we will get to the truth,” Cheney told me.
Starting September 27th, I'll be an Associate Producer for CNN's Capitol Hill unit! I'm so excited that I'll get to keep working with some of my favorite people in the business. Send tips!
During her press conference, Speaker Pelosi defended President Biden's strategy on sanctions, telling
@mkraju
, "This is a unified effort by our allies in the NATO alliance, and what was proposed was what was agreed to in terms of timing."
During the same press conference, Chairman
@BennieGThompson
noted that Democrat AND Republican leadership had been "informed" since the beginning about negotiations on the Commission. Makes McCarthy's public opposition yesterday even more unexpected.
Schumer leaves the Capitol without answering questions about the letter he and Manchin signed in July acknowledging Manchin’s top line of $1.5 trillion. “Read my statement” was all he would tell me.
"Where we are today is unfortunate, that the Minority Leader has at the last moment raised issues that, basically, we had gone past, and there was no issue on his part," said Thompson. "But I guess that's politics."
All of Indiana mourns her passing, along with the tragic deaths of her staff Emma Thomson and Zach Potts. Please join me in praying for their families in this difficult time.
"I got to check with my pastor" Manchin says as he and Warnock hug.
"That means we're getting ready to pass voting rights" Warnock needles before he walks off.
Manchin says he spoke “briefly” with Biden today. I asked him if Biden is moving closer to him on BBB, and he said: “I wouldn’t say that.” He also made clear he’s not changing rules to approve voting rights billl unless GOP is on board with rules changes. (Ds pushing him on this)
The House has passed a bill banning Russian oil imports, 413-9. It now heads to the President's desk for signature.

Manchin said the agreement he signed with Schumer was a “contract” he wrote, with the understanding that he would vote for the budget resolution if Schumer separated hard infra bill from social reform bill, and “[Schumer] asked me not to say anything”
Schumer says he would prefer if same-sex marriage came to the floor separate from the CR; Baldwin told

earlier today that she would also prefer that
@mkraju
reports that Tillis is satisfied with the information they have on Judge Jackson's CSAM cases - not pushing for more, unlike many of his GOP colleagues on this committee.
Schumer will file cloture on three top military nominees later TODAY, after multiple Republican threats to take procedural steps themselves. These are the nominees for:
- Air Force Chief of Staff
- Chief of Naval Operations

McCarthy tells
@mkraju
"I might" pick a successor. Notes that of the 8 who voted to oust him, "A lot of them I helped them get elected so I should have picked somebody else."
On Meet the Press, Durbin sharply rebuked Republican governors sending migrants to other areas of the country as "pathetic."
"I don't know if laws were specifically broken, but they have broken every basic standard of decency when it comes to dealing with children and families."
Rep. Dusty Johnson on this tweet: “If those conversations took place, the rest of the conference was unaware of them. And frankly, I doubt them. I haven't talked to the speaker about them yet today, but I would be a little surprised if that was a kind of a commitment.”
A reminder that during Speaker negotiations to build the coalition, that it was explicit both that nothing would pass Rules Committee without AT LEAST 7 GOP votes - AND that the Committee would not allow reporting out rules without unanimous Republican votes.

Rep. MTG met with Leader McCarthy for about 45 minutes. I asked if she would support him for Speaker if control of the House flipped. “No comment,” she replied.
Asked if he believes there should be new gun laws in the wake of the Texas shooting, Georgia Senate GOP nominee Herschel Walker told me in ATL: “What I like to do is see it and everything and stuff.” He didn’t engage further.
We’ve seen a few dozen House Republicans go into the Speaker’s office to meet with McCarthy, including three of his critics: Gaetz, Boebert, and Perry, who all arrived together.
My first job in D.C. was as an intern in Johnny Isakson’s office.
No one cared more about their staff, and no one was more respected by their colleagues on both sides of the aisle.
He’ll be deeply missed.
"Of course we're disappointed," Ohio Rep and Senate Candidate Tim Ryan told CNN. "We want all of it. I thought it should have been $3.5 trillion."

Jayapal to
@mkraju
, responding to moderate Dem claims that progressives are bluffing and won't kill the bipartisan bill if reconciliation fails: "They can take that bet if they want."
Update here: He was mid-interview off the floor with a network. As he went in he told
@mkraju
that he’d be voting for McCarthy again when they circle back to him at the end of the roll call.
Santos, to
@mkraju
: "I have not not done my job since I've gotten here. I can chew and walk gum at the same time -- I can chew gum and walk at the same time. And I'll continue to do that."
These are bad numbers for Jordan - only 25 more than Jordan had against Scalise, meaning 80+ members voted for a candidate that says he didn't know he was running this morning
Senate Intelligence Chair Warner Mark Warner left the briefing with DNI Avril Haines "very disappointed" by her responses on the discovery of classified documents at the homes of Pence/Biden/Trump. "We're left in limbo" by the special counsel. "It's not going to stand."
MANCHIN to
@mkraju
: "I haven’t walked away from anything, and inflation is my greatest concern, because of how it’s affected my state, people of my state and all over this country. And that's all I have to say. I don’t know what tomorrow brings."
If you’d told me a year ago that the second-biggest piece of a signature bill of this Congress was *$280 billion in tax giveaways to millionaires,* I’d have told you the Republicans were in charge.

Collins after 2nd meeting with KBJ: "She provided clarification on some of the issues, so it was a useful meeting and I’ll reflect on her answers tonight.”
Romney praised her, but noted his main concern is judicial philosophy (adds it's why he voted against her for DC Circuit)
McCarthy did not answer when I asked if he would make concessions to become Speaker, if Rs take the House.
@mkraju
and
@MZanona
have reported on House Freedom Caucus demands in exchange for their support, including making it easier to oust the Speaker.
Sen. Dianne Feinstein tells

“We’re gonna evaluate our options, but we will get to the truth,” Cheney told me.
USCP Chief Manger is giving an update on the situation now. Says all 3 Senate office buildings have been cleared, and they’ve “found nothing concerning.”
Asked
@SenSchumer
what an agreement on Build Back Better would mean - framework or text?
“You can't write the whole bill within the next few days,” he said, “but getting a framework done,” that all Dems can agree on is the goal this week.
Then, unlike now, there was a white knight: Paul Ryan. He initially resisted, liked his W&M gavel too much, and had to be dragged into the speakership with deep reluctance. But his name was always out there as a unique rep liked broadly by Rs. That person doesn’t exist today. 2/
215 members of the House have active proxy letters filed with the clerk, signaling just how many of them do not plan to vote on the omnibus in person tomorrow. This doesn’t mean all 215 of them will vote by proxy – some of these letters might be older – but they can.
Hawley told me this morning he “didn't want to be part of a photo opp asking for more money from the United States government when they haven't given us a single piece of accounting on anything they spent.”
Suspicious package reported at 1/6 committee Chair Bennie Thompson’s office. Multiple Capitol Police officers are on the scene. No sign of the package from our spot around 100 yards down the hall.
Manchin, when asked by another reporter if Biden should have committed to nominating a Black woman: "You must represent, basically, who we are as a nation. I think it’s far beyond time, far beyond time. It’s time to do it."
USCP issues a correction on the number arrested at an abortion rights protest outside the Supreme Court; it was 181, not 221. Rep. Judy Chu was among those arrested, per her office.

Asked about Biden saying COVID is "over," House Majority Leader Hoyer told reporters, "I guess ‘over’ is sort of subjective in terms of what does ‘over’ mean. Obviously the virus has not gone away, but it’s under control. You don’t see anybody wearing masks here."
Nice gesture — Murkowski, Sullivan and Democrats from several states flank Peltola on the House floor since she doesn't have a delegation to stand with her.

Tom Emmer (MN)

Manchin tells me he is a YES on ATF nominee Steve Dettelbach, after opposing Biden’s first ATF nominee.
“I’m going to support him,” he said, adding “these agents need leadership and they need someone who understands what they do and how vital their services are to our country.”
Cantwell, chair of Senate Commerce, says that committee votes on the FCC and FTC nominees will “have to wait until Senator Luján gets back,” underscoring again how difficult it is to balance a 50/50 Senate, down to the committee level
BIDEN: "Over the last 2 decades, more school-age children have died from guns than on duty police officers and active duty military combined"
"For God's sake, how much more carnage are we willing to accept?" he asks
Manchin on why he made his statement yesterday: “The President's over there. He went there. He asked for something before he left and everyone ignored it. I didn't ignore it.”

McCarthy told CNN's
@mkraju
that Biden "hasn't followed through" to revive debt ceiling talks.
"He hasn’t followed up from our last meeting, even though he said he would," McCarthy said, adding that if Biden waits much longer "he's putting the economy in jeopardy."
Scalise tells me he hasn’t seen the video of the attack on Paul Pelosi yet. As a victim of political violence himself, Scalise added, “it’s never acceptable” and “you always have to stand up against that, no matter where it’s coming from.”
Members are required to sign a letter saying that they are voting by proxy “due to the ongoing public health emergency.” Members of both parties have abused this system, but tomorrow might be the most proxy votes since it became an option – due to extreme weather and the holidays
