Former Justice Minister,

Great write-up by

Legislating for "the creation of a thought crime."
Congratulations to
@paulmurphy_TD
for this outstanding defence of Free Speech today in Dáil Éireann.
We need more opposition TDs to stand up the dystopian repercussions of this Hate Speech bill.
There is no democratic mandate in Ireland for the Hate Speech Bill, so why is it being pushed?
There is an international dimension to the Bill, not only in the precedent it sets, but in the effect it would have on other countries.
Our CEO,
@freespeechsarah
, explains:
Senator Denis O'Donovan of Fianna Fáil condemns the Hate Speech Bill for being "rushed" and unconstitutional.
In his 30 years as a legislator, this marks only the third time he has gone against his own party.
It is extremely worrying that the minister responsible for the Hate Speech Bill lacks the most basic knowledge of Irish criminal law.
The Justice Minister claims that there is no current law against incitement to violence. This is incorrect (see Criminal Procedure Act 2010).
Defending her hate speech bill, Justice Minister Helen McEntee repeatedly claimed that Ireland currently has no laws prohibiting incitement to violence.
@Ben_Scallan
asks if this means it's currently legal in Ireland to call for violence against individuals and groups.
In recent decades, Dublin has seen many incidences of rioting. These incidents never caused calls for scrapping freedom of speech. And the Hate Speech Bill would actually take Gardaí off our streets.

Her chief concern being the vagueness of the term of "hate" and how such a definition may change in 10 years time.
It's even worse: under this law, if the police suspect that your extended family might have evidence about the illegal meme, their homes could be raided too!
It's among the most regressive legislation anywhere in the world, and we need all the help we can get to fight it 🗺️ 🤝…
Bravo to Councillor Paddy Holohan for seeing through the Irish government's cynical erosion of civil liberties under the pretext of responding to the stabbing incident in Dublin last week.

Section 13 of the Hate Speech Bill means that managers and executives could face charges for a hate offence IF AN EMPLOYEE is found guilty of such an offence (e.g., hate speech or possession of hateful material).

Don't let this Hate Speech Bill become law.
Grace Sullivan, a lawyer and member of Free Speech Ireland, has said she is concerned about the Hate Speech Bill as “it makes use of the criminal law to restrict the freedom of speech protected under the Irish constitution.”
Apology demanded from
@DermotKennedy

Hate Speech laws will be weaponized by bad faith actors. Leave their social media outrage without the weight of the law.
Senator
@paul_gavan
of Sinn Féin announced that his party will have no choice but to vote against the Hate Speech Bill as is.
Gavan is concerned about how the law may be weaponized, and how Section 10 (possession of "hateful" material) dispels with the presumption of innocence.
We fully support councilor Paddy Holohan with this very important announcement.
Cross-partisan opposition from elected representatives like Paddy is key to pushing back on the draconian Hate Speech Bill.

The irony of

accusing

"You're obsessed with hate speech": Irish Foreign Affairs Minister Micheál Martin bats away a question by

about whether calling for the destruction of Israel would count as "hate speech" under his bill.
He added: "I'm not interested in the legislation."

@FineGael
@HMcEntee
This is completely untrue. Section 9 of the Bill makes the communication of "hate" an offence, regardless of whether it was successful in inciting someone to violence or hatred.
Furthermore, Section 10 makes it a jailable offence to even possess "hateful material".
The Seanad debate has now begun with opening remarks from Minister for Justice

The Hate Speech Bill is currently with the Seanad.
Here it can be amended but not rejected. Unfortunately this house hasn't power to do so.
However Senators do have the authority to remove sections pertaining to Speech. Effectively making this bill solely about "Hate crime".

In a few months time it could be the Gardaí compelled to arrest individuals on such grounds.
Violence is already illegal. It is disingenuous to argue that we don't already have laws on the books against harassment and assault.
Don't fall for the narrative that to stop violence we need to also outlaw opinions and protests.
Hate can’t be tolerated. Whether it is senators or influencers or their foot soldiers. Hate is transferable: The Jews, Muslims, Gay community, our trans friends, Asylum seekers, TDs, Doctors. Yesterday was the result of that tolerance. The Hate laws cannot be passed soon enough.
