Here's the context everyone is ignoring: The DOJ has had Parnas's phone & all these damning texts for 3 months. But we learn of them only bc a court order allowed Parnas to give them to the House a few days ago. Seems like Barr is covering up these crimes. And he's implicated.

Here's the context that Collins is ignoring: DOJ seized Parnas' phones and other materials when he was arrested in October, before he got the House subpoena. Parnas only recently got his devices back from the DOJ and secured permission from a judge to give this stuff to Congress.

I just voted in our primary, and I discovered I was officially an “inactive voter” because I “had not completed the census.” I 100% filed my census online last spring. Yet I had to fill out additional paperwork to vote today. This doesn’t make me feel better about November.

I’d much rather have a special counsel/independent prosecutor investigating the Jan 6 insurrection than a “bipartisan” commission, which would be partisan, dysfunctional & ineffectual anyway. The Senate GOP blocking a commission makes a stronger case for a special counsel.

I was looking back at Trump’s first press conference in Feb 2017 earlier, thinking about fact checking Giuliani, and I noticed something else. Trump kept putting himself in Putin’s shoes, thinking about how Putin would perceive all the pressure he’s under.

Overlooked: Cohen’s admissions implicate Trump Org’s CFO Allen Weisselberg in a felony. Weisselberg is actually a much bigger player in Trump world than Cohen. If Trump was laundering Russian money for decades, Weisselberg participated and knows where the bodies are buried.

The Mueller hearing is in jeopardy because House Dems are fighting over getting their precious 5 minutes of airtime. A modest proposal: Give NONE of the House Dem members questioning time. Give all the time to 1 or 2 committee counsel experts. That worked wonders in Watergate.

I think the House managers have done a great job. The problem is the Senate “judge and jury,” and as we’ve seen, the GOP Senators are only interested in obstruction and partisan spin. Let prosecutors investigate and then - in a real courtroom - get a clean shot at questions.

3/ Barr said his letter was to summarize the Mueller report. Mueller surely summarized his own report at the top, and without including privileged material. If the executive summary were not damning, then Barr would have included it. Release the executive summary immediately.

Tonight @maddow offered an important Watergate precedent for Mueller's choice not to indict. Jaworski did the same, because he was delivering damning factual evidence to Congress to let them make their own conclusions. That may be Mueller's intent, but Barr may be thwarting him.

I had said earlier and often that Trump would not face prosecution: the speeches themselves were *not* criminal incitement. But now: new questions of contacts before and during the insurrection arose. I think a criminal investigation is now likely, and an indictment is plausible.

I've skimmed the DC Circuit opinion rejecting Trump's immunity arguments. Yes, they took their time, but it was worth it. It's a thorough unanimous opinion that covers all the bases, so SCOTUS is more likely to deny cert, and more likely a trial starts.

I think I caught a major legal error on p. 5 of the OLC memo on #Whitaker . OLC argues that the Vacancies Act applies to DOJ statute 28 USC 508, because the DOJ statute cross-refers to the VRA. That would be difficult b/c Congress passed 28 USC 508 before the VRA. See my thread:

2/ Walsh's Iran-Contra Report and the Starr Report included a 1-page introduction or executive summary: 1) Written concisely, raising no exec privilege or national security concerns. 2) Presented damning conclusions. My guess is Barr held back the summary because of point #2 .

6/ If I were a state or federal prosecutor in Georgia, I would indict on election fraud based on Jan 3 phone call... AND call witnesses on Trump’s conduct before and during Jan 6 riot as evidence of mens rea/frame of mind (the call was clear enough but needs context).

5/ Kennedy had a duty not to resign until the Russia investigation had been completed. Maybe there is some unknown illness. We can let history judge Kennedy, his career, and this retirement decision. But it’s not just a retirement that threatens the legitimacy of the Court.

6/ This Supreme Court will hear cases directly impacting Trump and the Russia investigation: 1. Double jeopardy and dual sovereignty (Trump’s potential abuse of pardons). 2. Subpoena for Trump to be interviewed 3. The constitutionality of Mueller’s office or maybe his removal.

For 3 years, I'd annoyingly scold folks for saying Trump is the worst president ever, because I said that Fillmore, Pierce, & Buchanan (plus A. Johnson) openly siding w/ white supremacy and causing a civil war is far worse than anything Trump could do. I was wrong.

Update on the plot against Mueller: I can vouch for @jentaub and @NatashaBertrand 's story. On Oct. 22, Jen sent me a screenshot of this email offering to pay her for information (dirt) on Mueller, long before anyone had mentioned "Surefire Intelligence"... (i.e., @JacobAWohl )

@KFILE @ewarren 9/ Then I served on the Admissions Committee, which she chaired. As far as I know, it is very unusual for a top scholar/top teacher to chair an Admissions committee. But it was clear that she was more interested in giving young people opportunities, and making the process fair.

3/ Clinton’s only 2 appointments were in this first 2 years (RBG and Breyer). His impeachment scandal didn’t emerge until 1997. Stevens was 77, but didn’t retire. There was ample speculation at the time that he held on because of the impeachment scandal. Rightly so.

12/ UPDATE:Mueller’s team tells @nytimes : 1. Barr unfairly represented the report; 2. they wrote summaries for Barr to use! 3. Thus the DOJ excuse here (“the summaries contain privileged material“) is a joke. No way Mueller’s team makes that mistake.
