Sources close to Port of Dover and Eurotunnel are baffled by the PM’s insistence that there were only 174 lorries parked on the M20 during his press conference. At the time Boris Johnson was speaking @Kenthighways told me there were 500. The number has just risen to 945.

The unions argue that P&O’s UK crew were easy to fire because their contracts were issued in Jersey as part of P&O’s “offshore employment model”. I’m told P&O has c50 Dutch + French crew, employed on contracts in the Netherlands and France who weren’t dismissed yesterday. 🧵

Another slightly awkward issue for government is that P&O’s owner, DP World, also owns Thames Freeport - one of eight of the much trumpeted “freeports” in the UK. Freeports are the government’s big idea to encourage trade post-Brexit with simpler customs and tax regulations.

I’ve just spoken to a Polish HGV driver who calculates he could earn £2,000 a month more in the UK than he does currently in Germany. But he says he won’t be applying for a temporary visa because 3 months is too short. The minimum length he would accept is 12 months.

The PM also said delays were “only occurring at Dover” which handles “only 20%” of goods sent UK to EU. Boris Johnson failed to mention Eurotunnel which is another 26% (see EY report below) Dover + Eurotunnel = almost HALF of the goods sent UK to EU. Did the PM not know this?

Just over a year ago ⁦ @SteveBarclay ⁩ visited Norton Motorcycles. He called it a “great business” that would thrive when UK leaves the EU. Norton went into administration two days ago. CEO claims “uncertainties over Brexit” were a major factor in the company’s failure.

The @RMTunion says P&O plans to restart its ferry service in Dover using agency crew from India + will pay them the equivalent of $2.38 (£1.80) an hour. RMT doesn’t offer proof but this is plausible and - while some may find this shocking - it would be legal. I’ll explain… 🧵

Ever wondered what happened to all those shipping containers of PPE that were blocking the Port of Felixstowe? Around 7,000 of them are now here at Port of Ipswich. The government has rented more than 10 acres there to store them. Every one of these has PPE in it.

Seriously people - look at what's happening in terms of GDP/capita (which is what ultimately matters for our living standards). This is a proper recession just being hidden by having more people - GDP/capita declined 0.7 per cent in 2023 with falls in every single quarter

The UK Statistics Authority has reprimanded Laura Trott MP for stating (twice) that “taxes for the average worker have gone down by £1000 ”. UKSA says the public may have been “mislead - or at least confused” by Trott’s comments, which were made last November in the Commons…

The government says there are 1523 lorries parked on the M20 + at Manston airfield. Several hundred more spent the night in Dover and on the side of the M2. I know this because I passed them on the way home last night. This was Dover seafront. Spare a thought for the poor drivers

And don’t forget, the Channel Tunnel is closed as well as Port of Dover. Boris Johnson neglected to mention Eurotunnel at his press conference yesterday. As a result he told journalists that the chaos affects “only 20%” of UK-EU trade in goods - it’s more like 50%. PM has moxie.

At a time when the likes of Asda and Arcadia are cancelling clothing orders, Primark is pledging to stand by its suppliers. Company will ensure “everyone in a vulnerable country who worked on a Primark garment, whether completed or not, is paid for that work”. Deeply impressive.

How messy and unclear. The Secretary of State at the time the EU law was implemented was Chris Grayling. We don’t know whether he deliberately or accidentally left out the power of prosecution for companies who do not notify the flag-state authority. I’ve tried calling him.

Ignore the bluster. Boris Johnson will agree a trade deal with the EU. He will because he has been told that “no deal” will cost 280,000 jobs within months (on top of those being lost due to COVID), push up prices immediately and kick an even bigger hole in the public finances.

Were therefore eligible for furlough support. The RMT says P&O received £150m from Job Retention Scheme. It’s very possible that DP World also put extra money into the business to keep it going during COVID. I have sought clarity of all of the above from P&O but no comment yet.

I’m told that Flybe is waiting for the last scheduled flight to land tonight before putting the business into administration. The airline is expected to then cease operating. A formal announcement is likely to be made in the early hours of tomorrow morning.

Boris Johnson told MPs last week that he believed P&O has breached “section 194 of the Trade Union and Labour Relations Act of 1992”. This states that “an employer who fails to give notice to the Sectetary of State” before dismissing more than 100 employees “commits an offence”

So Section 193 says “notify the Secretary of State” And 193A says “don’t the Secretary of State, notify the flag-state” (in P&O’s case Cyrus, Bermuda etc) within 45 days. As it happens, P&O failed to do this too but the law doesn’t spell out what the consequences of this are.

BUT Section 193A was added to the act in 2018. It was originally an EU directive, designed to increase the protection due to seafarers. It requires the notification of “the competent authority of the state where the vessel is registered (instead of to the Secretary of State).”

Breaking: The German government and state of Hesse has decided to intervene to rescue Thomas Cook's German airline, Condor. Offering 380 million euros in form of loan guarantees (subject to EU approval). Airline is profitable and employs 4,900 people.

“There is an urgent need for action” Logistics UK has written to government to highlight a shortage of c76,000 HGV drivers. It says 1 in 3 hauliers cannot fill vacancies and that 1/3 of EU nationals working as drivers have returned to their home nations in the last year.

Pride of Canterbury is one of P&O’s ferries in Dover. If you look carefully you’ll see it is registered in Limassol (Cyprus). P&O trades internationally and its ships aren’t registered in UK so it is not subject to UK employment law and requirement to pay the UK minimum wage.

The Aviation Minister, @KellyTolhurst , is repeatedly telling MPs that the Job Rentention Scheme was not designed so companies could furlough staff and simultaneously announce redundancies. But it is not clear what, if anything, government intends to do about those that have.

BA isn’t commenting. Yesterday Willie Walsh told Sky that BA faces “the greatest crisis the airline industry has ever seen”. He added: “I’m not involved in the consultations, it’s the responsibility of the BA managent team...the reports I get are that some progress has been made”

CEO of the Road Haulage Association, @RHARichardB says: “disruption from 4th January is inevitable because businesses are not ready for the customs processes and they are not being given an implementation period. There will be chaos of the sort we saw in Kent this week”.

Government says that “due to data limitations” it doesn’t know what a customs and regulatory border in Irish Sea will cost businesses in Northern Ireland and rest of the UK. HMRC estimates suggest “administrative burden” will be “£15 to £56 per declaration”.

14 hours. The average time it takes a lorry to get to Calais after arrival at Port of Dover. Should take 4 hours. Getting to Dover is the other problem. “The town is gridlocked in all directions” my source, familiar with the situation in Kent tells me. What a mess.

In December 2018, Stephen Barclay - then the Brexit Secretary now the PM’s new chief of staff - said Norton was a “great business” and would thrive when the UK left the EU. In January 2020 Norton went in administration. It had received £5m in government support.

New: there are currently 2500 lorries queued on M20 and 500 on the A20. Tony Howe ( @KentHighways ) says Operations TAP + BROCK are at capacity and some drivers spent last night in their cabs. Says agency, port, Eurotunnel + police will get backlog cleared “as soon as possible.”

Another day, another queue of lorries outside Dover, this one stretched back 4 miles. Port of Dover has activated TAP - which permits the use of a lane of A20 for port-bound traffic - on 15 occasions since 8th January. Today, I tried to find out why. Full report up soon.

This is one of 2 ventilators that will go into mass production on Monday. Aiming for 10,000+ within weeks. Component manufacture + assembly will take place at Mclaren, Rolls Royce, Airbus, Ford, Siemans, GKN sites across UK. Govt can’t decide when to announce, consortium ready.

The failure of Flybe will be a terrible blow for staff and many regional airports who rely on the airline (see below). Eastern Airlines and Blue Island who operate some routes on behalf of Flybe (eg Norwich + Guernsey) are not part of the administration and will continue flying.

P&O reportedly wants to cut its wage bill in half. Offering agency crew from India £1.80/hour (well below UK min wage of £8.91/hour) would be legal and, I’m told, competitive. Other ferry operators also use non-UK crews - from countries like Poland and the Philippines.
