This article fails to address a major factor behind the attrition: the growing public awareness of this country’s broken and racist criminal legal system, and the prosecutor’s role in it. Perception of the job has changed rapidly since the summer of 2020.
Currently in virtual court, person incarcerated at Rikers was supposed to be produced for court date. Instead, DOC officer appeared on video and said he will not be available because “other inmates won’t allow him to be brought.” What?
On Rikers Island, incarcerated people are being forced to fight each other for the entertainment of the detainees who actually run the jails’ housing units. It’s on video. COs watch and do nothing, but ask them to be less obvious about it👇🏾
The world is watching Columbia University and the administration’s shameful decision to call the NYPD on its own student body.
Suppressing free speech and student protest will not address antisemitism or make us safer.
We know from decades of discriminatory policing that any such law will be disproportionately enforced against NYers of color.

Here is the provision of the final bill addressing the use of odor in police investigations. Odor alone can no longer be used as a basis for stop/search. Only exception is when investigating DWI and then, scope of search is limited. A real win for marijuana justice in NY.
Every judge should be required to watch body worn camera of a search warrant they signed being executed so they can see the way police needlessly tear apart people’s homes and damage their property. This is what the judge has authorized with their signature.
It’s been over a month since marijuana was legalized in NY, yet

has taken no action. Her office is still actively prosecuting marijuana cases, and has failed to vacate the hundreds of warrants that are outstanding (each one can lead to arrest and detention).
Another person’s case is called. Supposed to be virtually produced to court today. DOC says he was “moved to another facility” and “is under quarantine.” Not present for his court date.
The NYPD has been systematically depriving protestors who have been arrested of their legal rights and property, holding them for over 24 hours in crowded cells, and refusing to give information about their whereabouts.
Lost in the budget shuffle is an effort by

to increase penalties for cannabis possession. The intent is to shut down illegal shops, but the proposed bill would allow for a fine of up to $150K for ANYONE possessing ANY AMOUNT of untaxed cannabis.

Since discovery reform was enacted in 2019, NYC DAs have done everything they can to avoid complying with it. Instead of standing behind the law—which ensures people accused of crimes can see the evidence against them—the legislature is now prepared to roll it back. A true shame.
As attrition rates among prosecutors in New York rise, and the number of dismissed cases soar, a law that helped defense lawyers is likely to be changed.
The discovery laws are a scapegoat for a larger systemic issue. To address that, prosecutors should SUPPORT reforms that ensure that a person accused of a crime gets all of the evidence against them. Instead they are fighting tooth and nail to roll them back.
Rikers Island is the biggest threat to public safety in New York City. Anyone who spends time there returns to us in a less stable position than when they went in. And we pay over $1500 per day per person to maintain this. What an enormous waste.
People w/ mental health conditions make up 53% of the population at Rikers.
On average, they are held 61% longer.
We pay $556,000 per person annually to keep them in jail. 90% on Rikers are held without conviction.
By contrast, it costs ~$42k to put them in supportive housing.

In night court now. 57-year-old man sent to Rikers on $2,000 bail for possession of a small amount of heroin. The COVID rate there is nearly 20%. The City will pay over $6,000 for him to be incarcerated over MLK weekend. And DOC probably won’t bring him to court on Tuesday.
Everyone deserves to feel safe in our subways, but militarizing our MTA will do far more harm than good. As a public defender I have seen firsthand that safety is achieved through providing stability. Carceral responses have proven time and time again not to serve us.
New: Gov. Hochul announces that she is deploying 750 National Guard members into the NYC subways to conduct bag checks, in addition to another 250 law enforcement members. She is also proposing a bill to ban people convicted of a violent crime on the subway from public transit
This draft proposal from the “Senate” (which apparently most Senators have not seen themselves) does not contain “tweaks” but large-scale overhauls of both the bail and discovery laws. It must be rejected…
Rikers Island is by far the biggest threat to public safety in NYC. Every person that spends time inside comes back to us less stable than when they entered. We send people charged with crimes to the most dangerous and traumatic place in the entire city and expect change.

I am deeply troubled by the attacks on student protesters at Columbia University last week. We must protect students’ right to protest peacefully on campus, and Columbia must provide meaningful support to those who were hurt in this incident. (1/2)

Bronx “Police Reform & Reinvention Listening Session”—intended to be a forum for the community to give feedback to the NYPD—has some affiliation or relationship with the police. It’s not a listening session, it’s an echo chamber.
ADAs are leaving because they have been forced to reckon with this more directly, and for many it’s not worth it. The same thing happened with police officers.
Guess what - putting people in jail should be a hard job. Public defenders have been overworked and underpaid from the jump. If providing someone accused of a crime with the evidence in the case feels too overwhelming, please move on.
Only where there is evidence that someone is driving under the influence of marijuana would odor be relevant. And even then, only the odor of burnt marijuana. Searches must be narrowly tailored to uncovering evidence of that offense. Not a license to search an entire car.

likened criminal cases to a game of poker, and instructed prosecutors that they could go to trial without providing evidence to the person accused. Now she’s behind an 11th hour attempt to rollback NY’s discovery laws.
This effort by the NYPD to blame marijuana legalization for an increase in crime only further demonstrates how reliant they were on using pretext to conduct illegal searches rather than doing actually police work. What about the thousands of NYers searched who didn’t have guns?
Ask any public defender and they will tell you—what happened to Ms. Crawford happens every day in NYC’s criminal courts. Stay-away orders have unintended, but devastating consequences. I hope that her bravery in sharing this story will lead to real change.

As public defenders we are witnesses to the lies told by cops to justify their racist policing and prosecutions. Police plant evidence, falsify documents, lie about why they arrest or use force and lie while testifying under oath. Below is a thread with my contribution.

It’s unfortunate that the Gov’s bail proposal continues to be characterized as “mak[ing] it easier for judges to set bail for violent felonies” when in reality judges already have discretion to set bail in every single one of these cases under the current law.
NEW: Sources tell me that three-way budget talks halted temporarily on Saturday over bail. Staff for Hochul wouldn't discuss other parts of the budget and staff for Heastie walked away for a short time over the insistence to focus only on bail rollbacks
Aggressively confronting a 16 year-old on the street does not “foster peace.” Illegal frisks do not “foster peace.” Lying to the national news media does not “foster peace.” The violence in this case was entirely created by the NYPD, and their lack of accountability is shameful.
Another update in the C Blu story. NYPD finally responded. Like Mayor Adams, they avoided addressing the credibility issues of Officer Taulant Gjonbalaj.
James—who has an enlarged heart and several other medical conditions—spent nearly 3 months incarcerated at Rikers Island last year on misdemeanor charges. He caught COVID there. He was assaulted. He slept on a floor covered in feces. He witnessed suicide.
James was homeless. That was the reason he was still stuck in pretrial detention on Rikers Island. The prosecutor and the judge were willing to release him—but only if he had stable housing.
As noted in this article, an internal memo circulated to judges urges them to essentially disregard the Crawford decision. It's a stunning document, in which a court system employee instructs judges that an "evidentiary hearing" does not require the presentation of evidence.
In late June, a New York court issued a landmark ruling aimed at helping defendants avoid homelessness.
An internal memo obtained by New York Focus shows a top lawyer for the New York court system urging judges to do the bare minimum to comply with it.
It also creates a new criminal offense for willfully violating the tax law by possessing untaxed cannabis. Misdemeanor for 1st offense, felony thereafter. While intent may be to discourage illegal shops, experience shows that that criminal enforcement will be racially biased.
The 1st Dept. handed down a ruling this morning in Ms. Crawford's case, mandating that Criminal Courts hold a prompt evidentiary hearing when a stay-away order deprives a defendant of a substantial personal or property interest. This is an enormous win!
Ask any public defender and they will tell you—what happened to Ms. Crawford happens every day in NYC’s criminal courts. Stay-away orders have unintended, but devastating consequences. I hope that her bravery in sharing this story will lead to real change.
In an effort to address backlogs which are “denying justice to far too many,” the Gov budget allocates $100 mil to prosecutors…and $7.5 mil to defense. This inequity in funding will ensure that justice continues to be denied to those accused of crimes.

Prosecutors across NY state (and in 46 other states) have figured out how to successfully implement the discovery laws. But because 3 politically-connected DAs in NYC have refused to share evidence, the legislature is prepared to roll back the law for everyone. 🤔
Some data not in the story — dismissal rates have remained relatively flat outside of NYC, but in the city, the relative share of cases ending in dismissals have substantially jumped.
• Misdemeanor dismissals, 49% to 74%
• Felony dismissals, 27% to 44%
The sole purpose of bail in NY is ensuring a person’s return to court. Right now being sent to Rikers makes it MORE LIKELY that you will miss your court date.

Every tenant facing eviction deserves a lawyer protecting their rights in housing court. And the lawyers doing that essential work deserve fair pay, decent benefits, and manageable caseloads.

signs legislation legalizing marijuana in New York State. The bill was passed by both houses of the legislature last night. New York becomes the 16th state to legalize it.
The draft would allow prosecutors to proceed with a case even if police haven’t handed over evidence, completely invalidating Kaleif’s Law. The result is that an accused person does not see the evidence against them. With no penalty, police no have incentive to comply.
This language has not been debated or conferenced with members. It’s being proposed just hours before the budget is due. It is caving to fearmongering rather than following the facts. It is bad policy and bad process. It must be rejected.

It is with profound sadness that we share that our beloved Director of Organizing, Marvin Mayfield, has passed away. Marvin was a brilliant and buoyant warrior for freedom and justice. His love for the people and his family guided all he did. He taught us how to fight - and love.
It also vastly expands the definition of “harm to an identifiable person or property” in the bail law to include behavior such as petty theft. This will lead to many more people being held in jail for minor offenses—the exact problem that the bail reform of 2019 sought to address

N.Y.’s move to legalize marijuana will create a “significant shift” in policing and everyday quality of life, NYPD Commissioner Dermot Shea said as he voiced concerns over people being allowed to smoke marijuana in public.
None of the protestors who have been arrested and had their property vouchered can retrieve that property because the property window at 1 Police Plaza is closed because of the protests 🤔. This includes house keys, phones, prescriptions.
