I have been in and around DOJ since 1983. I have never seen a case dropped after someone has pled guilty and the underlying facts demonstrate beyond any shadow of a doubt he is guilty. This is simply a pardon by another name. A black day in DOJ history.

By law, firing an IG requires the President to provide a reason. That means a valid reason. “Loss of confidence” that results from the IG exercising his independence and doing his job is not a valid reason. This requires immediate oversight hearings.

I have conducted and supervised investigations for 35 years. I ran an investigative agency. The FBI supplemental investigation was not a real investigation. The FBI followed a cramped playbook written by the WH rather than following leads and interviewing all relevant witnesses.

Reminder: the head of Mueller’s legal team was Michael Dreeben, the most accomplished criminal lawyer in DOJ. He has been in charge of all DOJ criminal appeals for more than 20 years and has argued more than 100 cases in the S Ct. So his legal analysis was trumped by...whom??

Barr makes this clear today: he didn’t simply misinterpret Mueller, he overruled him- “WE DIDN’T AGREE WITH THE LEGAL ANALYSIS..IT DID NOT REFLECT THE VIEWS OF THE DEPARTMENT. IT WAS THE VIEWS OF PARTICULAR LAWYER OR LAWYERS, AND SO WE APPLIED WHAT WE THOUGHT WAS THE RIGHT LAW.”

People who know nothing about law enforcement should not opine on it so glibly. Judges make decisions on warrants — FISA, domestic surveillance, search warrants — on the papers, without a hearing, all the time. That is the norm, not the exception.

Durham’s statement is unprecedented and inappropriate. In the 30 year history of the DOJ IG, no prosecutor working on a related matter has ever issued a statement designed to contradict or undermine IG findings. It is grounds for a disciplinary referral.

Mary Shannon Little is dead on. Giuliani would have torn up the plea agreement of any cooperator who was acting as a double agent and impaneled a grand jury to investigate the lawyers for obstructing the investigation.

When I was a prosecutor working for Rudy Giuliani, if a defense lawyer representing a cooperating witness continued to participate in a joint defense agreement, he would have investigated that lawyer and others in the joint defense for obstruction of justice.
