As a court reporter, and a freelance one at that, the all-out strike by the
@TheCriminalBar
impacts on me. But I've seen the toll our country's once-admired justice system is having on so many brilliantly-minded people who have invested years of study at huge expense to be able
Counsel trying to list a sentencing hearing in w/c July 18 are told that strike action is proposed for five days that week. However, one optimistic barrister asks: "Why don't we take that date and hope the government sees sense." The judge replies: "I can't possibly comment."
If your loved one is ever accused of or becomes a victim of crime, you'd want the best legal representation. But their pay does not reflect the service they provide. In fact it's nowhere near. So action is now demanded.
A sentencing hearing where there was no prosecutor has been 'saved' at the 11th hour by a barrister, already with a heavy caseload of her own, stepping in to do the job - yet another example of legal professionals going above and beyond to keep a crumbling legal system on
Please, any reporters covering court take note. We DO NOT 'take the stand'. We 'give evidence'. There is no 'stand'. We go into a witness box. It really is quite simple. We are not in the US. I'm tempted to hammer this home with a picture of a gavel but we don't have them either.
I'm sitting in court with a coat over my legs, while jurors all have their coats on. This is what they find when they are asked to perform their public duty. Yet another sorry state of affairs which, judging by Twitter today, is being experienced at courts around the country.
THREAD: END OF AN ERA. Today has been one of the hardest days of my professional life as it was my last one as a court reporter based at Maidstone Crown Court. I cannot even begin to tell you how much the people who work in that building mean to me. It's been an absolute
A barrister who successfully prosecuted the abusers of a six-week-old baby -
@TonyHudgell_fdn
- so badly that he had to have his legs amputated was paid just ยฃ8 an hour. Maybe that explains why there is a lack of prosecutors. It's definitely not an issue of 'no-shows'.
Record numbers of victims are being denied justice as their cases are being aborted at the last minute because of โno-showsโ by prosecution barristers, official figures show.
A woman arrived in a wheelchair for a hearing on the second floor at Maidstone Crown Court - where there are no working public lifts. It meant judge and clerk moving to the first floor and security helping the woman up the stairs. The state of court buildings is quite shameful.
I watched a young, fairly new usher at Maidstone Crown Court today dealing with a distraught woman about to give evidence and was touched not just by how reassuring and gentle she was but also by how brilliantly she handled the situation. A real asset to the court staff team.
A barrister at Canterbury Crown Court was mid-flow questioning his client, on trial for wounding, when a juror's phone rang with music from 'The Good, The Bad and the Ugly'. Once it had been silenced, the barrister quipped 'Back to the Wild West of Canterbury....'
Two trials (one a backer) listed in same court at Maidstone today. One has no prosecutor, and the other no defence counsel due to other legal commitments or cases over-running. Judge told that all attempts to secure cover had failed - 20 sets of chambers contacted for one case
Judge tells defendant he will give him 25% credit for his guilty plea, bringing his sentence down from '12 months to eight months', to which his counsel promptly corrects him 'Nine months, Your Honour'. Another barrister is overheard to whisper 'He'll thank him for that!' ๐
Day Two in the Maidstone 'strike' house and the lack of defence barristers is having great effect. Trials, sentencing, et al being adjourned. This is how to make a point. Well done to all at
@TheCriminalBar
Explaining why prosecution and defence barristers had 'swapped sides' on counsels' row, a judge at Maidstone Crown Court told a jury: "The state of art technology which has just been updated only works from one port. You couldn't write it."
Striking barristers backed by
@paula_hudgell
as it's revealed the prosecutor who secured the convictions of her son's evil abusers was paid just ยฃ8 an hour.
Back in September 2020, a man was arrested for allegedly refusing to wear a Covid mask at Bluewater shopping centre and charged with assaulting two PCs and damaging a watch. His trial date? It will be March 2024....
A barrister was given a dressing down by a judge today - for not dressing up, or more to the point, not having the buttons done up on his jacket and showing 'too much white shirt'. Judge remarked he wasn't offended but others might be. Discuss.

Out of six trials listed to start at Maidstone Crown Court today, five proved ineffective with four having no prosecution counsel. On the same day
@TheCriminalBar
has warned of the lack of prosecutors. And on the first 'back-to-work' day for striking defence lawyers. One trial
A court usher went above and beyond usual duties today when at Canterbury Crown they were asked to act as the victim in an attempted murder trial so a pub landlord could demonstrate to the jury how he says he accidentally stabbed his wife in the back after stumbling on a dog toy.
A judge has apologised to a young defendant facing six sexual offences, including three of rape, who must wait until January 2024 for trial. "I'm sorry you are going to have to wait that long and that is going to be difficult for you. But there is a huge backlog of
A judge, on spotting counsel appearing to rise to her feet, asked whether she had anything to add, only to be told 'No, sorry. I was just excited to leave!' I admire her honesty ๐
A disabled juror who'd sat through a 2wk trial at Maidstone Crown Court had to be discharged due to faults with all five lifts in the building. Enquiries revealed no date could be given for when repairs would be undertaken. Yet another consequence of budget cuts
#thelawisbroken
It's never easy as a reporter standing up in court to tell a judge who proceeds straight to sentence that the facts of a case have never been opened and must be opened in the interests of justice. But it has to be done.
estate. So now is the time for barristers to finally take such a massive step, or we may not ever have a justice system worthy of admiration ever again.
to represent any one in need - the guilty and the innocent. Forget Covid. This mess was created way before that by government cuts and underfunding which affected not just barristers but also the police, CPS, court staff, judges' sitting days, technology, even the buildings. Also
Again, we have a wheelchair user struggling up stairs at Maidstone Crown Court today because the public lifts aren't working. Nor is the disabled toilet. And the external lift for disabled access is locked. You have to use the ramp instead to go into reception and ask for a key!
A woman arrived in a wheelchair for a hearing on the second floor at Maidstone Crown Court - where there are no working public lifts. It meant judge and clerk moving to the first floor and security helping the woman up the stairs. The state of court buildings is quite shameful.
forget the lie perpetually peddled that barristers earn a fortune. It's as much a myth as newspapers paying ยฃยฃยฃ for stories. Today's decision is quite rightly making headline news nationally but reporters on the ground locally have been making noises for years about the crumbling
Note to reporters: A plea and trial preparation hearing is not a trial. Therefore, it is incorrect to report someone has pleaded guilty 'during his trial'. Some may think I'm being pedantic but it makes a big difference, especially in terms of sentencing.
Interesting crown listings on Courtserve today - the first day of defence barristers' strike action. Some courts have unusually marked every single case with 'All parties to attend court'. All I can say is good luck and best wishes to everyone who stands by their vote to strike.
A defendant in custody on drugs charges due in court for a plea and trial preparation hearing 'has refused to get out of bed because the barristers are on strike', a judge at Maidstone reports. Fair enough, I suppose.
When told trial date is September this year for a non-custody case, judge remarks 'That can't be right.' Sadly, and all too depressingly true these days, he was right. Actual date (warned list) - May 2023.
A custody time limit application at Maidstone Crown was adjourned from Tuesday until today, with strict instruction from the judge that the defendant be produced. He's been taken to Warwick mags instead. CTL runs out tomorrow. This is the mess that is the criminal justice system.
Reached another new height of security checks at Maidstone Crown Court today. Not only did I have to empty my bag, flick through the pages of my book and unzip my purse but also had to open my leather phone case. Oh, and I was also asked why I was there...It's a public building.
Maidstone Crown Court has said goodbye to another valued and well-respected clerk today, Marion Crittenden. Having decided to hot-foot it into retirement, the Strictly fan was given a perfect 10 for her many years of service by the judges this morning. They even had scorecards!
'...make sure that there was a live link beamed into the cell of the sound and/or send pictures...' says former Justice Secretary Robert Buckland.
Blimey, that would be some achievement considering the issues just to get a link to a prison video room....
Interesting reporting by the BBC of the Mendy rape trial verdicts. Going into a lot of detail regarding his lifestyle and what he and his defence team said in court, when he still faces another trial later this year. Usually, the rule is to report the NG verdicts and little else!
A show of appreciation for the two barristers that gave the names of the animals involved in a dangerous dog case today at Maidstone. This is exactly the detail us court reporters love and often find ourselves having to ask at the end of hearings.
Just imagine being charged with a crime and not only having to wait more than four years for your trial but having to spend a staggering 45 months on a tagged curfew, preventing you from leaving your home for nine hours daily. What a sad and sorry state of affairs in our 1/2
I keep seeing media reports lately of court hearings which carry lines such as 'prosecutors told the court' or 'said prosecutors'. To be very clear, the prosecutor speaking is singular. I will now file this with my other pet peeves which include 'taking the stand' and 'pled'.
A POCA hearing listed at 10.30am at Maidstone has been adjourned after Serco indicated that a van would not be at the prison in Suffolk to pick up a defendant until 12noon and staff would need lunch before setting off on the expected 3hr journey, so ETA was 4ish. Absolute farce.
Trial involving four young defendants (three are teens) at Maidstone Crown Court and dating back three years was listed to start today. But no prosecutor despite 'phone calls to 25 sets of chambers and emails to 100'.
I struggle to put into words how proud I am of
@paula_hudgell
today. She thoroughly deserves such incredible recognition for her determined and successful campaign for Tony's Law and I am honoured to have been trusted by her to play a small part in it.

This OBE isn't just for me it's for Tony & all the other children like Star & Arthur who either lost their lives or suffered at the hands of the people that should have protected them.
It was wonderful to receive the honour by HRH the Prince of Wales.

Almost six years ago today I cried in court for the very first time as a court reporter. Today, I could cry again at the news surrounding that same case. But it was inevitable and I must also reflect on all that has been incredibly achieved since by an amazing woman and friend.
A jury has been discharged today from a trial which sat for one week, was then delayed by barristers' action last week, and now can't go on because of indefinite strike. New trial date? November 2023. Date of offence? March 2018.
I'm just going to let those reporters with limited court experience know that if you plead guilty to a charge, your sentencing hearing is not a trial. Trials are solely reserved for those who plead not guilty.
Heard a barrister exclaim 'What a wally!' after viewing bodyworn camera footage of a driver being chased for 20mins by police, reaching 100mph. I haven't heard 'wally' used for a very long time, but it's perfect for describing so many misdemeanours. Let's bring back the wally!
A judge has apologised to families of a defendant and the victim of an alleged road collision who, having waited more than two years for a trial, turned up at crown court to hear the prosecutor was involved in another case 60 odd miles away and no cover had been provided.
First day back at court but not much has changed - no heating, toilets out of order, cases delayed by Covid, no food or drink provisions in the building. Happy New Year everyone!
A man sitting in the public gallery at Maidstone Crown has been escorted out of the courtroom after a judge spotted he had fallen asleep. He was criticised for not showing 'respect and dignity'. In his (limited) defence, he wasn't snoring. ๐คฃ
Three years ago today evil couple were jailed for horrific cruelty on their 41-day-old baby. They received the maximum sentence under current law which means they will be free in less than two years. Help
@paula_hudgell
in her fight for Tony's Law.
A suspected thief giving evidence during an attempted murder trial raised a few laughs in court when, having asked the judge if he was 'Judge Stevens' and told that it was, he replied 'Hello. Long time no see!'
New job, new venue but lots of friendly and familiar faces to help settle me into my role as reporter at Canterbury Crown Court, plus a couple of 'welcomes' from judges too ๐
In a three-handed hearing at Maidstone Crown this morning, judge remarks he has 'lots of lawyers', to which one replies, amid much laughter, 'Enjoy it while it lasts!'
@DanielJaeWebb
The only good thing to see in this footage is people getting involved to help rather than just walking on by or filming. Well done to that dog walker ๐๐
When you're late for court and a warrant is issued for your arrest, you need to have a good excuse up your sleeve when you're finally collared by the judge. How about this? "I had to buy a new shirt. I bought one but didn't realise until I tried it on it had short sleeves."
As a court reporter, I've survived the backlog, the pandemic, and the Criminal Bar action. But I think Common Platform may be the straw to break this camel's back.
For anyone wondering about the impact of strike action by defence barristers, I know five out of six trials listed to start today (three were backers) at Maidstone Crown Court were ineffective because of no legal representation. The defendants, some in custody, confirmed
court), just THREE are sitting this week due to a lack of judges and recorders. And we are still a week away from 'no returns' action. It can, and will, only get worse. Brace yourself.

Barrister on CVP informs court he cannot access case papers as he has lost all Wifi while workmen install/upgrade broadband outside his home. Judge quips: "After the day we've had, I wonder if everyone lives on your street!"
A plea and trial preparation hearing for 11 men charged with violent disorder linked to the 2020 Euros football tournament has been given a time estimate of 90 mins. Very apt!
A High Court judge has today lifted a Sect 45 anonymity order on a three-year-old alleged manslaughter victim who died on Christmas Eve 2019. Mr Justice Cavanagh heard an application from myself, made on behalf of
@ferraripress
and other interested media parties.
Just a polite reminder/nudge to barristers and judges to say that the media doesn't have access to the digital case system/common platform so it's vitally important - in fact, essential - that the facts of a case are opened in court.
It has been announced today that Her Late Majesty The Queen appointed Oliver Saxby KC to Circuit Judge. He will be sitting at Maidstone Crown Court, Kent, and is a very welcome addition to the Bench!
Just calculated that I've spent about six hours on a story (almost five of them in court), only for newspaper websites to use a police press release that lacks detail and, more worryingly, misleading information. Why? Because it's free.
Yesterday a judge at Maidstone 'joked' it took longer to get a defendant up from the cells than one to travel from Leeds. Today, a judge said Feltham YOI had told court staff it was easier to transport a defendant to court than arrange a video link. I kid you not....๐คทโโ๏ธ
A High Court judge has just praised a murder jury for their 'supportive attitude in the finest tradition' of those asked to carry out such a duty. His remark came during a trial fraught with delays and which should've ended last week but is still on pros evidence. This led to...
The bag search for entry at Maidstone Crown Court stepped up a gear today - the contents had to be tipped out! Imagine the look of horror on every handbag-carrying woman's face ๐คฃ And yes, it took much longer to put it all back. ๐คฃ
"Pointless and purely decorative" - Judge at Maidstone gives his verdict on the Covid-19 perspex screens along counsels' rows, which are too low when standing and block off microphones.
Messenger Group as their crown court reporter at Canterbury. A new venue but still doing the job I love - and still tweeting! I'll miss you Maidstone โค๏ธ
I have written many words over almost four years about the incredible Tony Hudgell and his inspiring mum Paula but today I am proud to write the most important words of all -
WE HAVE TONY'S LAW!
What an amazing achievement, one we have prayed for and worked long and hard over!
@pkonline84
Jury selection is random and no doubt this will be sorted by the court and common sense. A key worker was excused jury service at Maidstone Crown in the first lockdown when he told a judge he repaired hospital equipment. Judge said his services were needed far more by the NHS.
Judge Charles Gratwicke, sitting at Maidstone Crown, deals with a defendant greeting him with 'Hello darling' and a phone ringing with his usual charm and grace ๐ He even managed to ignore her giggles when, told her next hearing was Nov 5, she said. "They'll be sparks!
Yet another barrister questions the delays at Maidstone Crown Court in preparing custody pre-sentence reports. I've said it before and I'll say it again - it's four months. So, prepare yourselves.
I not only had the good fortune as a kid to be taught by Len Goodman, but also had the great joy of meeting him years later at work - and he did not disappoint, even sparing a few extra mins in his busy day to dance with me. RIP Len. Heaven has gained much more than a 'Seven!'
As a court reporter, I'm used to hearing the jury warnings about ignoring what may be published by the media. However, today one judge has just added: "In this building we are served by very good journalists who report accurately." Always good to hear!
