My newest op-ed is out. In it, I crunched some numbers. We hear all the time from police & prosecutors about "felony arrests" to get harsher policies passed. But what actually happens to felony arrests?
Over 80% of them are dismissed. A thread w/ facts:
He was 14 when he was falsely arrested & prosecuted. 14. Years. Old. His trial lasted a single day. He spent 17 innocent years behind bars & the rest on state supervision. Impossible to heal. And no one will be held accountable.
A 15 YEAR OLD GIRL HAS BEEN JAILED FOR THE LAST 2 MONTHS FOR NOT DOING HER HOMEWORK. A 15 YEAR OLD GIRL HAS BEEN JAILED FOR THE LAST 2 MONTHS FOR NOT DOING HER HOMEWORK. A 15 YEAR OLD GIRL HAS BEEN JAILED FOR THE LAST 2 MONTHS FOR NOT DOING HER HOMEWORK.
For context on Manafort’s 47 months in prison, my client yesterday was offered 36-72 months in prison for stealing $100 worth of quarters from a residential laundry room.
“One day, from his sniper nest, Gallagher shot a girl in a flower-print hijab who was walking w/ other girls on the riverbank. She dropped, clutching her stomach, & the other girls dragged her away.” This is who he pardoned & honored.
Albuquerque SWAT team raids house looking for an alleged robbery suspect. Using nuisance Flashbangs to get the suspect out ignited and engulfed the home in flames. After the fire, police find the body of a 14-year-old boy. He was not the suspect.
Don’t talk to police. If you are going to say words to police, they should only be “I want to speak to a lawyer.” That invokes your right to silence under both the Fifth & Sixth Amendments. All questioning must cease. Don’t talk to police. If you are going to say words to police,
The
@ManhattanDA
charged this man being punched in the face with violent felony assault on the cop. The claimed injury was the *swelling to cop’s fist.* Read that again. Take it in. Then read this: This happens routinely. Prosecutors are shameless enablers of police violence.
*This* is the face of Trump's war on immigrants. A 17-month-old baby. Juliet. Returned last night to her mom. Asylum seekers from Honduras. Separated & detained by ICE for 2 months. This is the scene from SFO. Listen to her cries. Bear witness. This is trauma. This is too much.
A Black man was murdered. They strangled the life from his body. On camera. We all saw it. Just feet away. Clear as day. He pleaded for his life. They kept strangling him. Eric Garner is dead. The cameraman is jailed. And the killer is still making salary. This is white supremacy
Meanwhile, a man I represent is jailed on Rikers right now, unable to afford bail, after successfully doing check-ins for last 9 years bc he failed to update his new address when he recently became homeless. Faces up to 4 years prison. Epstein didn’t check in once since 2011.
Where is the justice? A Tennessee court ruled that Cyntoia Brown, a
#SexTrafficking
survivor, must serve 51 years in prison before she is eligible for parole
Every time police arrest a white mass shooter alive & w/o shooting is an another powerful reason to reject the police “they-were-armed” justification and narrative after killing a Black person.
A young woman was found dismembered in Brooklyn. Truly awful case of what appears to be long running domestic abuse. NYPD previously responded at least 6 different times. Police don’t prevent or deter violence. They just don’t.
NEWS: My god. $820 million. NYC taxpayers will pay *$820 million* in just overtime for NYPD this year. Could instead house all 14,000 homeless families in NYC. Then years of rent for 7,000 families out of work & at risk of eviction. With millions left over.
No idea what actually happened w/ Jussie Smollett. But do know that 4 years ago, Chicago PD spent 13 months justifying Laquan McDonald’s murder before releasing dashcam video showing he was walking away before being shot at 16x by an officer. Why are we just accepting their word?
I cannot believe the NYT published a front page story 2 days ago about how police were "defunded" when every police department everywhere got increases.
Jim Acosta: “How does the “Forward Party” feel about Roe v Wade?”
Andrew Yang: “The “Forward Party” has a—not left or right- but “forward” stance on even the most divisive & contentious issues.”
Jim Acosta: “What does that even mean?!”
“The killer posted on Facebook that he might “kill a few people on my way to work,” got in his car, ran a red light, drove directly into a Black Lives Matter protest, & shot and killed a protester because he felt “threatened.” And Texas Governor Greg Abbott plans to pardon him.”
Less than 24 hours after a jury found an Army sergeant guilty of shooting and killing a protester, Texas Gov. Greg Abbott announced that he would pardon the convicted killer as soon as a request "hits my desk"
As a public defender, I represented literally hundreds of Black men & women accused of doing this. Most literally couldn’t afford $2.75 subway fare. Difference between eating/not. Arrested, caged, forced to plea to the crime of “theft of services.” But when you’re white & proud:
Horror. A man, his partner, & 2 children. 11 y/o & 6 months. Stopped by ICE. On way to doctors appointment for the baby. Local police shattered his window, ripped him out, & handed him to ICE. Only let him say goodbye to one of his 2 kids. “I want daddy.”
@realDonaldTrump

Heart pounding. Watch this male lawmaker scream over his female colleague for 3+ minutes while she tries to read a powerful letter written by a formerly homeless man begging them not to end public assistance. This *is* the GOP. Heartless. Angry. Abusive.
“One day, from his sniper nest, Chief Gallagher shot a girl in a flower-print hijab who was walking w/ other girls on the riverbank. She dropped, clutching her stomach, & the other girls dragged her away.” Trump is preparing to pardon this war criminal.
Alabama murdering a man by drowning him w/ nitrogen. Kentucky introducing a bill to legalize the murder of unhoused people. Mississippi burying hundreds in unmarked graves. Texas fighting for the right to murder migrants. States imprisoning women for health decisions. “Pro-life.”
This is astonishing, yet not surprising. If it feels like you're far less safe in NYC than ever before, it's not bc shootings are up. It's because the media (fueled by lies & fearmongering by NYC Mayor Eric Adams) is up. Look at this chart. Red line is shootings. Grey is media.
Fiona Apple has a story for you. And it’s incredible. Asked me to share.
She's become an avid, trained Court Watcher. Her observations helped people jailed pretrial file a civil rights lawsuit. Then came the retaliation. Shut off her access to court.
A video story in 8 parts:
A cop slapped a handcuffed man dying of a drug overdose. Called him a “bitch.” Shoved a baton in his mouth. That cop got suspended 6 days. But the cop who revealed the cruelty was expelled from the cop union. Now faces 20 years prison for whistleblowing.
PLEASE READ: Conditions on Rikers are unimaginably bad. My colleague has spoken to a few people trapped inside. What they told her is horrifying. Unless
@NYGovCuomo
,
@NYCMayor
, & all DAs do something ASAP, we're looking at mass death. What they're reporting:
BREAKING: Trump’s DOJ *retried* a man simply for providing humanitarian shelter and medical aid to 2 immigrants at a volunteer camp set up to rescue migrants. First jury deadlocked. Second jury: Total exoneration. Victory for humanity.
Anytime you hear a “rise in crime” or “spike in shootings,” remember: whatever they claim, is happening despite investing most on policing in the history of the world. A brutal indictment of the efficacy of policing. Yet police are using their pathetic failures to demand more?
Video starts w/ cop already illegally inside her car. Shes calm. Asks “Why am I being apprehended.” Then he pulls out stun gun. Points it at her face. “GET OUT OF THE CAR.” She complies. 3 days later she was dead. All for failure to signal. They kept her video hidden for 4 years.
Don’t let him distract you. *This is what he doesn’t want you to watch. His deportation force violently stealing away a man who has lived in this country for 25 years & then strangling the woman who had the courage to film it.
How copaganda works. Police release a highly edited video that doesn't include their unprovoked, violent, & unjustified attack on a migrant. Manufactured "outcry" ensues. Lawmakers call for sweeping policy changes. New video later released. It's too late. Profound damage done.
🚨PEOPLE: It is really happening. The Minneapolis City Council *just* announced their intent to disband the Police Department & replace it w/ a new community-led system that truly prioritizes the safety & health of community. Transformation. Not “reform.”
It’s really mind-blowing seeing the
@nytimes
—one of the chief purveyors of false/misleading “doomsday headlines” about crime in NY & around country—now reporting on the electoral impact of their own harmful journalism practices. And yet mentioning only other papers & “media.”
Cop: “Show me your ID.”
Man: “No. You just pulled up in front of my f*cking house & told me I have a warrant from Louisiana.”
Cop: “Because you had a dog walking.”
Man: “So what? That’s my f*cking dog!”
Stopped for being Black while playing w/ your dog on your front lawn.
‘You don’t know my name, so how can you tell me I have an open warrant?’ — This officer tried to arrest a Black father in front of his own home after incorrectly identifying him as a suspected criminal from another state
🚨🚨🚨JUST IN: MASSIVE VICTORY IN CALIFORNIA! CA Supreme Court just ruled unanimously that "the state cannot keep people behind bars simply because they cannot afford to post bail pending their trial." Cash bail as we know it over in California. Speechless.
This is Susan Farrell. The first woman to die of COVID in Michigan prison. She was 74. Served over 30 years for allegedly killing her husband, who sexually & physically abused her. Just heard from her bunkmate, who alerted guards. They put her in solitary for it. It's even worse:
If your citizens can’t afford the $2.75 fare to ride the subway, perhaps you need to invest more money into them instead of police to beat and arrest them for it
WATCH THIS. *Hundreds* of NYPD steal subway fare & walk through exit gate. W/o masks to boot. Laughing at bystanders. NYPD tickets or arrests 1000s of mostly Black & brown people for this. Taxpayers pay hundreds of millions for police on subway. 2 systems.
Powerful photo of one of my favorite judges-Judge Simpson-consoling Mr. Bunn. "I am more than emotional about this day," said Simpson as her voice cracked. "You were 14 at the time. This shouldn't have ever happened."
🚨🚨Impossible to overstate how big of a deal this is. I’ll say this for now: This fancy sounding legal term, “qualified immunity,” basically makes it impossible for officers to be held liable for even the most egregious civil rights violations. So it leads to more. Colorado!!
‼️BREAKING‼️:
@GovofCO
has signed
#SB217
into law. Colorado becomes one of the first states in the country to END qualified immunity as part of this historic comprehensive police accountability bill.
This is madness. ICE tried to raid a *homeless shelter* in NYC on Tuesday night. Lied that they had a warrant. Thankfully, security guards knew their rights & asked to see it. They showed a random photo. They didnt have a warrant. They were forced to leave.
My 19 y/o client put on NYPD gang database for being on periphery of a photo, taken 3 years ago by someone else, posted on another’s Facebook page, of a group of around 10 young men hanging outside. One had a gun. Meanwhile she poses daily w/ weapons of war while issuing threats.
People I represent get arrested & jailed for missing a single courtdate for sleeping late, inability to afford $2.75 subway, another appointment they had to make, or just forgetting. They “see what happens.” It’s never a question whether the law will get enforced against them.
This is a breathless, sensationalist lie from a NYT reporter. NYPD has never come close to “solving” 90% of anything. And violent crime didn’t “spike.” All major crimes, save for homicides (still at historic lows), continued their 30+ year decline. Why are you doing this, Ali?
Pre-COVID, NYPD was solving nearly 90% of murders. But that rate plunged over COVID, even as violent crime rates spiked.
I spent 2 months with a family as they went from hopeful, to frustrated, to distraught, waiting for NYPD to catch their son’s killer.
“I am the third teenage girl who has tried to take care of this little 2 year old boy. I feed him and give him water. I also take care of another little kid. She calls me ‘mama.’ She is 6 years old.” Testimonials from caged children read by other children:
I've spent last 5 hours analyzing footage of NYPD brutality against protestors. A lot on my mind, but forefront: If anyone I represented were accused of anything close to the indiscriminate savagery perpetrated by cops, they'd face violent felony charges & years in prison.
MINDBLOWING: The same police force that murdered Breonna Taylor hid **750,000** records of sexual abuse of minors **by their officers** and then lied to keep those files secret. Louisville's Metro Council voted to increase their funding this year. Don't even know what to say.
Absolute bombshell of a report from The Courier Journal: LMPD hid almost 750,000 records documenting the sexual abuse of minors by Louisville police officers, and then lied to keep the files from the public
“Three police have been placed on administrative leave after they reportedly watched as a man drowned.” As the man’s wife screamed for them to help, they threatened her: “If you don't calm down, I'm going to put you in my car." Uvalde is not an anomaly.
Alabama sends bodies of people who died or were killed in its jails and prisons to their families without their hearts, brains, & other organs and w/o their consent.
Reading this cynicism while sitting in Brooklyn Court waiting for my client, presumed innocent, to be brought into court from Rikers in shackles, as I see person after person, presumed innocent, brought into court from Rikers in shackles. Behind me, a mother weeps & prays.
A Tennessee cop was texting at night, while driving a restrained woman in his back seat, bragging to his wife about making his first arrest, ran his car into a river, killing him & the helpless woman he had just arrested. This is the headline. The story barely mentions her.
Fiona Apple stepped up. After a federal judge dismissed dozens of sworn declarations from inside jail as “unhelpful” & only “marginally relevant.” She didn’t want anyone to ignore them. So she read their words. “I’ve lost my spirit, sort of given up.” More:
Eric Garner.
Sandra Bland.
Freddie Gray.
Sam Dubose.
Philando Castile.
Terence Crutcher.
Alton Sterling.
Jamar Clark.
William Chapman II.
Walter Scott.
Eric Harris.
Tamir Rice.
Akai Gurley.
Stephon Clark.
Tony Robinson.
Laquan McDonald.
And ~2900 victims since Michael Brown.
2 cops brutally attack an elderly man. On camera. Let him bleed. Leave him for dead. Lie about their actions. Get caught. Don’t even get fired. Just suspended. And every single other member of the “elite unit” *quits in protest.* The culture of policing.
Good morning. At about 3am this morning, NY Democrats passed the harshest & most racist bail bill in New York history. At this time. Of all times. Gutted.
READ: For all those now reading this thread, before I go any further: I am not making the argument for *harsher sentences for anyone including Manafort.* I am simply pointing out the outrageous disparity between his treatment and others, disproportionately poor & people of color.
Something important just happened. People illegally caged pretrial in Prince George's County, MD risked retaliation & *sued* the jail where they're *currently jailed.*
The lawsuit is powerful. One of clearest I've read. Reads like a Twitter thread. I've posted it for you below.
Brandon Bernard. Sentenced to death at 18 as an accomplice. Attorneys declined opening statements. Called no witnesses at penalty stage. 11 of 12 jurors were white. 5 of them now don't want death. His prosecutor has called for mercy. Bill Barr wants him executed on Dec. 10. More:
Police lie. All the time. Everywhere. Everyday. On routine paperwork. In conversations w/ prosecutors. To supervisors. In court. Under oath. In press conferences. To reporters. On TV. In legal filings in lawsuits. To victims and survivors of crime. Uvalde is nothing new.
25 years ago, the US Supreme Court ruled that cops could use any pretext (read: lie) to stop a car to search it & courts would not secondguess their motivations—race or otherwise. Car stops of Black & Brown people exploded. Congress & state legislatures can & must change this.
It just happened. I’m in Florida about to board a flight to LaGuardia. And over the loudspeaker: “Attention all Jet Blue customers. We just received word. The mask mandate has been lifted! Feel free to board your flights without masks.” A loud, sustained cheer just erupted.
Headline today is Trump calls off US military cemetery visit due to bad weather. Meanwhile, Obama, Memorial Day, 2010. Better, stronger in every way 👇.
My client’s stuck on Rikers, charged w/ “violent felonies” for stealing bikes for resale value to support his addiction. 1st arrest ever. No actual violence. Meanwhile, Weinstein is free to live in his mansion, travel freely round NY & CT, & elsewhere w/ permission. Two systems.
Harvey Weinstein handed over his passport, agreed to wear a GPS monitor, and will need to get the court’s permission to travel outside of New York and Connecticut
Today, I argued to a judge that a young man I represent shouldn't do time in prison because he'd come out more damaged than when he went in. That prison wouldn't serve any value of Justice. He looked shocked. "But you could say that for any one going to prison!" Me: "Exactly."
The former NYPD spokesman had to wait until after he retired—out fear of being labeled a “traitor” and a “hypocrite”—simply to state publically that killing Eric Garner was a bad thing.
There are actual studies. It is not a question anymore. Marijuana is not a “gateway drug.” But the impact of criminalization *is* known. It drives broken windows policing & devastates Black & brown communities.
Gut wrenching. NYPD in subway surround woman selling churros. She’s crying. They’re telling her she stops or get arrested. Trying to talk to them in Spanish. Rolling their eyes at her. Lead out of station in cuffs. Cart taken away. This is police violence.
Teen Vogue does it again. The leader in justice journalism. Instead of amplifying police talking points, they profile 11 young Chicago leaders & give them the mic. On how to achieve safety. "Punitive systems only create more cycles of trauma & violence.” A thread of their wisdom:
Anytime you hear a “rise in crime” or “spike in shootings,” remember: whatever they claim, it’s happening despite investing most on policing in the history of the world. A brutal indictment of the efficacy of policing. Yet police are using their failures to get even more?
San Diego Police Department just gave me comment on protests of "stay-at-home" order in San Diego:
"We have decided not to enforce the law at this time. We welcome people to voice their frustrations and concerns in a peaceful way. We hope after they've done so, they'll disperse."
Yesterday, a man was released after serving 35 years for robbing a bakery of $50.
Today, 2 NYPD officers accused of raping an 18 y/o woman in their van & bribery will receive probation.
I just witnessed the most extraordinary moment. Judge David Carpenter in Bessemer, AL has resentenced Alvin Kennard to time served after he got life without parole for robbing a bakery of $50 in 1983. He is now 58 & was 22 when he committed the robbery.
The cycle:
1. Arrested because poor.
2. Court fees imposed. Can’t afford.
3. License suspended for not paying.
4. Need car for work, appointments.
5. Arrested for driving w/o license.
6. Court fees imposed. Can’t afford.
7. Rinse. Repeat.
Governors: Take note of Virginia👇
In case you missed it. The NYPD spent $150 Million *extra* last year to catch people who weren't able to afford to pay the subway fare. They owed just $104,000.
$150 million could buy free fares (at going rate) for 95,000 poor New Yorkers per year.
Thinking right now about this moment. Diane Feinstein hugging Lindsey Graham at the end of Amy Coney Barrett’s conformation hearing. She called the hearing “one of the best” she had been involved in.
Good morning. Michael Thompson is 68. Serving 60 years in Michigan for a marijuana sale 25 years ago. Mom, dad, & son died while inside. Was cuffed at his mom's funeral. Her dying wish was he wouldn't die in prison. He was just hospitalized w/ COVID. More:
2 minutes 20 seconds. Of terror. Dozens of transit police officers. Guns drawn. People fleeing. All to arrest a young man sitting down, his hands in the air, doing nothing. This is a militarized police out of control. And they hired 500 more for the subway.
Just to state it as clearly as possible: Democratic Governor Kathy Hochul just won her election, w/ a Democratic supermajority in both the state senate & assembly, & has a historic opening for chief judge of NY’s highest court. And she nominated a *conservative, pro-life, judge.*
Alternative headline: The overwhelming majority of people in the United States support President Biden’s decision to recommit to the Paris Climate Accord & rejoin the World Health Organization. What is this garbage
@ABC
?
Yesterday, a pro Trump caravan, escorted by Fort Worth police, tried to intimidate voters by driving through a polling station in a predominantly Black neighborhood. But the community wasn’t having it.
