Antitrust remedies in Europe have utterly failed. Not bcs “no case to answer in the first place” (says Google) but bcs “cease and desist” is an invitation to keep at it, just tweak it slightly we wont come after you. EC pretends all going great, regulation will now have to do it

ok, let's do this. I've now read all 153 pages of United States vs Google filed earlier today. As I've said earlier, Google is royally screwed. The suit is super well-written building on prior work investigating Google’s market power abuse leveraging advertising technologies. /1

In terms of Facebook's argument that buying Instagram and WhatsApp wasn't anticompetitive and bad for consumers, the Court throws in the compelling point of how Facebook pulled back its own investment in its own product after the deal. Point taken. /5

Not really: market definition is not the gating item, always done ex post. Last section to be written in decisions/complaints. Real issue is to nail the conduct (foreclose, envelop, exploit) & remedies. Not done enough for too long, can’t wait even longer hoping tech will fix it

EC scraps 2008 economic guidance on exclusionary abuse & infamous #As_Efficient_Competitor - the go-to test in so many cases. Aside from super fragile (can get any number you want) it’s also deeply ideological: “if you are not as efficient as the incumbent, you deserve to die” 1/
