I'm going to court on my own tomorrow. No solicitor, no counsel. It's literally just to be on the safe side for client, and I will absolutely not need to do anything (and don't have the authority to do anything anyway), but I don't care - it feels like Christmas Eve right now!!!

Ultimately though, legal aid is a form of payment for lawyersโ€™ work. Iโ€™m not sure why thatโ€™s taboo. Thereโ€™s a perception that, if lawyers arenโ€™t working for free, theyโ€™re corrupt. Legal aid lawyers are rarely rich, and almost always overworked. We deserve to be paid for our work.

Itโ€™s not a perfect system - and I wonโ€™t even start on criminal legal aid which is a complete mess because of govt failures. But itโ€™s a way of people getting support at their very lowest moments. Iโ€™m proud to be a future legal aid lawyer, no matter what our govt says about them.

A thing I have to do too often: reminding the Legal Aid Agency that they have been provided with counselโ€™s opinion confirming the merits are good, and that the LAA caseworker who discharged my cert for โ€˜poor meritsโ€™ is, in fact, not a practising member of the Bar.

In 2012, the LASPO Act massively reduced the scope of legal aid. I canโ€™t begin to count the number of clients I have to turn away because their case, however strong/serious, falls outside the scope of funding. The Act has drastically threatened access to justice in the UK.

You do not *only* qualify for legal aid if youโ€™re on benefits. It makes the application easier because you donโ€™t have to fill out as much info, but around 40% of my clients are working. Some are retired. Some canโ€™t work because of sickness. And *some* are on benefits.

The threshold for legal aid qualification is terrifyingly low. Most of my clients are living in relative poverty, probably made worse by the legal problem they are instructing me on - street homeless; losing their home; living with abusive partners; living in an unsafe house.

Legal aid is beneficial for ALL parties involved. Litigation works so much more smoothly when people are professionally represented. If all current legal aid clients suddenly became litigants-in-person, chaos would ensue, for them AND for their opponents.

The scope of issues covered by legal aid is also extremely narrow. Eg., you can only get funding for a disrepair claim if your health and safety is โ€œat serious riskโ€. Iโ€™ve had legal aid turned down for clients living in absolute squalor.

BUT if you recover money as a result of action brought or defended under legal aid, you (often) barely see any of it because you pay stat charge. So the illusion that legal aid clients get taxpayersโ€™ money to bring claims for thousands of pounds is inaccurate.

Most importantly, the cases that clients are fighting are, by virtue of the narrow scope and issues faced by those in lowest social classes, extremely grave. People facing homelessness, people living in dangerous buildings, people being treated unlawfully by government bodies.

Also, in some areas of law, if you win your case, you can recover all/most of your legal costs from the opponent. So if your case is strong, you might not require a penny from legal aid. Legal aid should be seen as a safety blanket in the uncertain world of litigation.

Next, damages. Damages claims can be brought under legal aid in VERY narrow circumstances, and only when thereโ€™s been a pretty egregious wrongdoing e.g. unlawful eviction.

My probably very simple/uninformed view on the cab rank rule debate: it is not a lawyerโ€™s place to pick and choose the laws that they help to enforce. By all means take issue with them, but if you want to play a part in changing them, become a politician, not a lawyer.

Days of action then! What an entirely avoidable shame 81% of those who voted did so with days of action in mind. Imagine that. 4 out of 5 barristers want to work within a properly funded system that has any kind of legacy, such that they will risk punishment by their regulator

Yesterday: booked train ticket to court, then realised it says on the order that itโ€™s a CVP hearing. Today: got up early to put on makeup, do hair, and generally make myself look smart for said CVP hearingโ€ฆ which has just been vacated. ๐Ÿ™ƒ
