More on the Fulton County docket: Judge McAfee DENIES Ken Chesebro’s request to exclude certain evidence at trial. Chesebro argued that some memos and emails he wrote were attorney-client privileged. But McAfee concludes that the documents fall within the crime-fraud exception.

Chesebro's plea is a significant victory for Fani Willis. He has admitted to facts that implicate several "big fish" co-conspirators & agreed to testify against them at future proceedings. And prosecutors won't be forced to show their cards over the course of 4+ month trial.

When removing a case to federal court, the defendant—Clark—bears the burden of showing that he acted under color of federal office and that he can raise a “colorable federal defense.” To carry that burden, Clark needed to admit evidence supporting both of those factors.. 2/

Jones indicated that there are some exhibits filed by Clark that he may allow into evidence. Even so, it’s hard to see how Clark can carry his burden for removal absent the declaration or testimony. And that is precisely what Fulton County prosecutors argued in closing… 5/
