The National Catholic Prayer Breakfast will present an award to Attorney General Barr for “Christlike behavior” tomorrow morning. A.G. Barr has ordered the executions of six men with at least one more on the calendar. What is “Christlike” about using discretionary power to kill?
Justice Sonia Sotomayor’s dissent tonight in U.S. v. Dustin Higgs will be remembered long into the future as one of the most thorough, resounding indictments of this administration’s reckless, immoral, illegal effort to execute as many people as possible, as quickly as possible.

I raise my voice in fervent opposition to the National Catholic Prayer Breakfast's scandalous offer of an award to Attorney General Barr for his "exemplary Christlike" behavior. I urge the group to immediately rescind their inivtation, and I urge anyone reading this to join me.

Los Angeles District Attorney Jackie Lacey, who put 23 people on death row, has been defeated by DA-Elect George Gascon, a death penalty opponent who will never put anyone on death row, will never request an execution date, and will work to re-sentence those already on death row.

AG Barr just set three more federal execution dates in addition to the two already scheduled in December. The federal government just executed Orlando Hall last night. If Barr gets his way, six people will be executed between Election Day and Inauguration Day. This is a disgrace.

is trying to rush through as many federal executions as possible during the “lame-duck” period between now and January 20, 2021. DOJ lawyers have informed federal judges that more execution dates will be announced soon. This shameful killing spree must end.
In yet another after-midnight ruling, the U.S. Supreme Court has allowed the federal government to proceed with Lisa Montgomery’s execution immediately. This decision will forever be a scarlet letter for the SCOTUS — a complete failure to protect our most vulnerable citizens.
As we see more and more breaking news about presidential pardons, remember that this is all happening at the same time that the outgoing Trump administration is rushing to execute as many people as possible right up to the eve of Inauguration Day.

South Carolina just halted two scheduled electric chair executions to allow more time for death row prisoners to decide if they'd prefer a firing squad execution instead. This absurdity is the product of the U.S. Supreme Court's backwards, regressive 8th Amendment jurisprudence.

There are currently thousands of prisoners fighting wildfires in California for pay of $2/day and $1 extra for every hour spent on an active fire line. These firefighters are barred from working in civilian fire departments after release from prison due to criminal records.

STATUS UPDATE: Rodney will NOT be executed next week. The execution has been legally blocked by the Texas Court of Criminal Appeals. Rodney's case will go back to the trial court in Bastrop for hearings on hidden evidence, false testimony, and actual innocence.

NEWS: Charles Ray Finch has been officially exonerated. He is the 166th innocent person freed from death row in the U.S. Charles was convicted and sentenced to death way back in 1976. He spent 43 years in prison for a crime he did not commit. Welcome home, Charles!
BIG NEWS: The Washington Supreme Court outlawed the death penalty this morning. Washington is the 20th state to abolish capital punishment. The ruling also converted the death sentences of the eight men on Washington's death row to life sentences.

NEWS: The U.S. Supreme Court just ruled that Oklahoma prosecutors cannot try Native Americans in state courts for crimes committed on tribal lands, upholding the sovereignty of the Creek Nation and other tribes. This will result in the reversal of some Oklahoma death sentences.
Spend a few minutes in the criminal justice system and it becomes clear that it is a system of technical rules and regulations that always work against poor and marginalized people. The system has very little to do with actual justice.
Two Harris County judges accounted for more than one-fifth of all children sent to state prisons in Texas last year. Nearly all of the teens sent into prisons by the judges—96 percent—were children of color.

A jury found Derek Chauvin guilty of murdering George Floyd. The conviction of one individual is a small measure of justice when we have a system that remains plagued with centuries-worth of racism in the law and in practice. I pray that this will be a catalyst for real change.

Courts get things wrong. In the U.S., our Supreme Court upheld slavery, Jim Crow, forced sterilization, anti-miscegenation laws, forced internment, and more. These decisions were eventually overturned and repudiated. One day, the same will happen with the death penalty.

Missouri has executed Amber McLaughlin tonight. Her life story was filled with abuse, trauma, mental illness, brain damage, and intellectual disability, all culminating in a horrible crime. Amber was deeply remorseful for her actions but the system showed her no mercy.
On a 5-3 vote (Justice Gorsuch not participating), the US Supreme Court overturned the 10th Circuit’s stay and will allow Oklahoma to resume executions today. Once again, the Court abdicated its legal and moral responsibility to prevent cruel and unusual punishment.

Lisa Montgomery was tortured, raped and abused throughout her entire life. She experienced a psychotic break and committed a horrible crime. The government has been medicating Lisa for years in an effort to make it look like she is competent. This execution should be stopped NOW!
Dobie Gillis Williams was an innocent man with an IQ of 65. His trial lawyer was disbarred. Prosecutors removed every Black potential juror from the jury pool. I was Dobie's spiritual adviser and I was there when he was wrongfully executed in January 1999.

The U.S. Supreme Court has refused to block Ray Cromartie’s execution. It appears that Georgia will go ahead and kill Ray tonight. This is shameful. DNA was never tested. Someone else confessed to the crime. The victim’s daughter asked for the execution to be stopped.
Did you know that the U.S. Supreme Court has ruled that there is no constitutional right to DNA testing of crucial evidence in criminal cases, even when a person is facing the death penalty? People are routinely executed while untested DNA evidence sits in an evidence locker.
What is Christlike about a Catholic believer using his discretionary power as Attorney General to undertake a series of speedy federal executions? In contrast, those in power before him for 17 years chose not to seek death.
NEWS: Melissa Lucio was granted a stay of execution by the Texas Court of Criminal Appeals. The April 27th execution date is canceled and Melissa’s case will be sent back to the Cameron County trial court for consideration of four claims. Alleluia!

This afternoon, a judge ruled that it is unlawful to carry out executions by use of the electric chair or firing squad under the South Carolina Constitution's prohibition against cruel, unusual, and corporal punishments. This reinstates a de facto execution moratorium in S.C.
NEWS: The U.S. Supreme Court just granted a stay of execution for Ruben Gutierrez in Texas! This means that Ruben will not be executed today and the lower courts must consider his legal challenges.

The SCOTUS has denied Brandon Bernard’s petition and this unjust execution will move forward now. Justices Breyer, Sotomayor, and Kagan would have granted a stay. Justice Sotomayor published a six-page dissent that lays out many of the legal reasons why this execution is wrong.
NEWS: The U.S. Supreme Court just struck down non-unanimous jury verdicts in state criminal trials. This ruling means that each juror must vote ‘guilty’ before a person can be convicted of a serious crime. Laws that allowed non-unanimous juries were rooted in racism and bigotry.

Did you know that there are at least 300 veterans on death row in the United States? Many of these men and women experienced serious trauma—mental and physical—over the course of their military service, often left untreated and unaddressed. We need to do better by our veterans.

I’m appalled to hear that the federal government executed Daniel Lee early this morning after the U.S. Supreme Court issued a seemingly unprecedented opinion at 2 am. While we were all sleeping, the government killed a man under cloak of darkness. I will have more to say soon.
Oklahoma argued that many residents will be surprised to learn that they’ve been living on tribal lands. Justice Gorsuch replied that members of the Creek Nation who signed the original treaty in 1832 would also be surprised to find them there.
