Sikkim is currently seeing massive statewide protests.
The reason? A Supreme Court verdict delivered about two weeks back.
While deciding who would be eligible for a tax exemption given in the state, the court said Sikkimese Nepalis were of "foreign origin". (1/n)
The Gyanvapi suit is found to be maintainable today. Here is a history of how India’s courts have helped escalate Hindutva claims on mosques in the past as well via

One of the most interesting people I spoke to for the same-sex marriage case.
From being in a heterosexual marriage for 16 years, to finding her sexuality and now, filing a petition for marriage equality, Maya Sharma has seen many ups and downs
While it is being reported that the Court has asked SBI to disclose the serial numbers of the electoral bonds, that is not the case.
The court has only issued notice to SBI on this, which will be taken up on Monday.
However, there's another list coming out on Sunday. (1/3)
Though this part features in the observation and is not part of the judgement's main ratio, it has touched a nerve regarding a long-standing identity debate in the state. (2/n)
There are three main communities in Sikkim: Lepchas, Bhutias and Nepalis.
Though Nepalis have a numeric majority in the state, they have often been labelled as "outsiders".
Several groups are now trying to get the court to expunge these remarks. (3/n)

@ArvindKejriwal
in Court : Why have you arrested me?
ASG Raju : We have a statement against you.
@ArvindKejriwal
: So if I say I gave 100 crores to
@narendramodi
and
@AmitShah
, will you go and arrest them based on my statement?
The Judge and ASG both went quiet.
However, the dispute goes way beyond this observation in the judgement.
What is happening in the dispute now? What is the history behind this dispute?
Read my explainer on this topic, coming out tomorrow. (4/n)
"...the collegium has taken cognizance of what was drawn to our attention, or came to our notice, after we formulated our recommendations..."
That means the IB/Government did not bring to the collegium's notice the comments made by Victoria Gowri?
Now that the data by SBI is out and it is possible to match donors to parties, did former finance secretary Shubhas Chandra Garg lie when he said SBI cannot match donor data to political parties?
Under him, the bonds were first floated.
AM Khanwilkar is a judge who may not have received as much press as Ranjan Gogoi or Arun Mishra, but his judgments have been no less adverse in pushing back civil liberties jurisprudence and giving more power to the executive. (1/2)

Can a member of a political party be appointed as a judge? Should they be?
Justice Victoria Gowri's, a BJP member accused of hate speech, appointment has thrown open many questions about the political affiliations of judges.
The answer may be more common than you think. (1/n)
This will be published on Sunday, and should (hopefully) provide some information on the details of who had given bonds to which parties.
Meanwhile, the issue of SBI releasing the alpha numeric codes of the bonds will be heard on Monday (3/3)
These stories take a lot of time, effort and resources to do. It is the contributions of readers that keep our newsroom going.

When the hearings were ongoing, the court had asked the EC to collect data from the political parties regarding the donors against each bond, donated amount and when it was encashed by the party.
This list has data from the inception of bonds to Sept, 2023.

BJP is claiming that the SC has vindicated its decision to demonetise, and has been boasting about the success of demonetisation since the judgement has come out. But does the judgement say demonetisation was a good decision?
No.

In 2015, JB Pardiwala, one of the judges in the EWS case, made a remark that reservations have held India back from progressing and also said that reservations were meant to be there for 10 years. (1/n)
Ramana often makes headlines, talking about the independence of the judiciary, keeping the executive in check. But how much of it has translated into actions? Very little.
Here's how one year of his tenure has been. via

Five years after one of the biggest policy blunders we have ever seen, the Supreme Court is yet to even form the 5-judge bench which was supposed to listen to the issues relating to demonetisation.
Here's is all that happened in the case.

Recently the SC asked UP government to withdraw recovery notices sent to alleged CAA-protestors. Now the government may take action under a law it passed in 2020.

I've also decided to tweet about the books I read this year (and read a lot more).
Book 1: The Feast of the Goat by Mario Vargas Llosa
A beautiful read on the end of the regime of Rafael Trujillo, a dictator from Dominican Republic.
August 24, 2017 was a historic day. A 9 judge bench of the court declared right to privacy as a fundamental right.
But 5 years since the judgment, what has changed? Not much.
Every day we are only hearing about colleges being apathetic to the demands of the students during a global pandemic.
Which are the colleges that have taken student-friendly steps?
If you know any, drop a comment or a DM. Will like to write about them.
RT please. Thanks!
The state has a lot of options in instances like these: criminally prosecute rioters and also take damages from them.
But one thing they cannot do is go around bulldozing houses. Here's why.

The Indian government has brought in new rules that allow it to withold pensions of retired bureaucrats who have served as high-ranking officers in some of the most coveted government jobs.
Last year, Nepal saw massive protests over the "master of the roster" powers to its Chief Justice. 18 out of 19 SC judges had boycotted hearings. The complaints were similar to that of the Indian Supreme Court (1/4)

There have been 10 recusals in the Bhima Koregaon case, 5 at the Bombay HC, 5 at the SC. The judges haven't given a reason.
Should judges start disclosing reasons for their recusals? Some believe it'll make the system more transparent...

There's a lot of talk about bail but less action. SC's new judgment clarifying guidelines and asking for a new law is also on similar lines. Will it change things?
Lawyers are apprehensive.

The Bill allowing for linking Aadhaar to voter ID database was bulldozed through the Lok Sabha today amidst protests from the Opposition.

There are many problems with the remission given to 11 convicts in the Bilkis Bano case, the affidavit filed by the Gujarat government before the Supreme Court shows. The affidavit says that they were released for "good behaviour". But on what basis?
Though the primary challenge to Gowri's appointment was her comments against minorities, there's a long history of politically active judges.
According to one academic, as many as a quarter of SC judges between 1950-89 had been politically active before their elevation. (2/n)

MPs said that his remarks were unconstitutional and that it was distressing that Pardiwala was unaware that this 10 yr prescription was only for political reservations.
He finally expunged these remarks. His original remarks are in Para 62 here: (3/n)
