Stock is lying. The judge did not specify that.
As a lawyer who attended the entire trial, I can confirm that both the prosecution and X's defence highlighted evidence that shows transphobia is a factor.
These people are disgusting ghouls. Even when the judge specifies that transphobia was not a factor, they don't care. They have been making money from needlessly terrifying kids and parents for years, and now they are DESPERATE to concretise the monster, no matter what the facts.…
1/🧵Some snippets of Dame Cass’s report. Despite their effort in masking, it is quite evident that 𝐭𝐡𝐞 𝐂𝐚𝐬𝐬 𝐫𝐞𝐯𝐢𝐞𝐰 𝐰𝐚𝐬 𝐬𝐞𝐭 𝐮𝐩 𝐭𝐨 𝐩𝐫𝐨𝐦𝐨𝐭𝐞 𝐜𝐨𝐧𝐯𝐞𝐫𝐬𝐢𝐨𝐧 𝐭𝐡𝐞𝐫𝐚𝐩𝐲 𝐚𝐧𝐝 𝐢𝐭 𝐝𝐨𝐞𝐬.
Let’s look at Recommendation 4. So they claim
Imagine. You are abducted to a park. A friend, who knows all your vulnerabilities shouts “gay!” A stranger suddenly stabs you. Your life is about to end. Do you perceive it as a hate crime against you?
The lack of empathy in some of the reports I have seen is quite chilling.
The killer’s messages demonstrated actual hostility related to Brianna’s gender.
We were told not to speculate on motive. We didn’t know why initially. During the trial, I learned it was because they had more than a mere motive. They found hostility, an aggravating factor.
1/🧵 Dame Cass’s illegal data sharing.
I have reviewed the Gender Recognition (Disclosure of Information) (England) Order 2022. It appears, on its face, the order is defective and it does not give effect to its intended purpose.
2/ …there isn’t good evidence regarding social transition. And out of the blue they assert there’s a “lesson” from the studies of children with DSD. And it’s somehow applicable to trans people.
Paragraph 78 is particularly shocking.
3/ The recommendation's wording itself is suspicious enough. Who are the clinical professionals? What do they do when they see them?
It appears to be intentionally vague so they can run conversion practices.
7/ This is the most disturbing main recommendation. It's often believed that GIDSs are being replaced with many smaller services, yet, in reality, they want a centralized national board for controlling trans children.
4/ This is their way of referring to "social contagion" without explicitly using the phrase. The MPRG serves as the primary anti-science apparatchik within NHS England, established specifically to enforce the directives from the infamous Bell v Tavistock (first instance) case.
11/ This is utterly ridiculous and scientifically illiterate; it's impossible to have a placebo effect without a control group.
Placebo refers to sham puberty blockers. People taking puberty blockers cannot experience the placebo effect. What on earth are they talking about?
6/ Yesterday, it was revealed that the so-called University of York paper was authored by a conversion therapy lobbyist. Now, Dame Cass is promoting a centralized "cherry-picking" program.
12/ Let me be absolutely clear. Being non-binary is valid, and it's not a middle ground. It certainly does not magically alleviate dysphoria. It certainly does not justify gate-keeping or conversion practices.
“The Cass report goes against the consensus of professional medical associations around the world and I don’t think it is relevant to practice in Australia,” Associate Professor Ada Cheung said.
9/ You might wonder why they are so obsessed with finding trauma. It seems to be the golden thread running through both the Tilly Langton (University of York) paper and this part of the Cass review. It is to enable conversion practices.
10/ There were speculations that the Langton paper excluded evidence based on double-blind criteria. It appears the paper does not explicitly state that because, obviously, such a vile stance cannot pass peer review. So they put it in the main review.
“Could be placebo effect.”
I'm the first scientifically trained trans person to have skimmed through the entire Cass final report from the midnight when it was released to 5 am. I take pride in the fact that Cass cannot counter or address any of my criticisms.
Them: bUt HaVe YoU rEaD tHe CaSs ReViEw??
11/ Reading these paragraphs together, it's unsettling how Cass seems to view actively converting kids with significant dysphoria to non-binary as a middle ground. Bizarre.
I don't think the conversion therapists she emboldens would agree tho.
Hey
@UofGlasgow
, your finest “academic lawyer” is willing to misrepresent and disguise the appellant’s (Marie-Luise Vollbrecht) failed submission as the court’s conclusion in order to further his ideological cause.
Is there a formal complaint channel?
2/ NHS trusts are separate legal persons. Sharing protected information between them for non-medical purposes is illegal under the Gender Recognition Act.
So, Dame Cass sought special authorisation for data linkages between the trusts and disclosure to her research programmes.
Brianna Ghey: What to expect from sentencing
“Beyond transphobic hostility, there are many other statutory and non-statutory aggravating factors that are relevant to the case.”
3/ The schedule to the authorisation order defines authorised persons as employees or appointees of the trusts, relevant NHS business units, and the University of Bath.
This renders the order defective since the trusts themselves are not authorised to disclose information.
4/ The trusts can become criminally liable.
It is unclear who would act as the data controller under data protection law if an NHS trust employee, authorised by the Order, decided, on their own initiative, to facilitate a Cass review research programme.
1/🧵 I'm both an engineer and a lawyer, and I happen to be trans. I have insights into conducting double-blind studies on the risks and benefits of puberty blockers.
It's not impossible, and promoters of conversion practices like Dame Cass and Tilly Langton won't be pleased.
My complaint against Elizabeth-Jane Peatfield. I won't be making any further public comments until the Advisory Committee/JCIO completes their investigation. While it is not advisable to file multiple formal complaints, you may express your...
13/ You may also wonder why the MPRG report (see 4/🧵) is not held to the same “rigorous” standards to be accepted as evidence in the report. Do they have a non-harassment control group?
7/ Another point of unlawfulness is the demonstrably inadequate opt-out period of 3 months. I doubt it will withstand judicial review.
Who proposed it, and when? Is it about getting it out before the general election? I should make a freedom of information request.
Today, I heard that Brianna Ghey had to turn to private healthcare. If she were alive, upon learning about Dame Cass’s unlawful recommendations, which contradicted NHS and anti-discrimination laws, she would have faced overwhelming stress, much like every trans kids in England.
6/ Finally, the authorization order explicitly refers to the Cass review, which has concluded. It does not extend beyond the review period.
Recommendation 5 is legally illiterate.
1/🧵 Patient data is exclusively the patient's.
There is nothing inexcusable about an NHS trust following the law.
We live in a scary time when the Shadow Health Secretary
@wesstreeting
doesn’t treat people as individuals, and independent public bodies as equals.
1/🧵The Department for Education (England) has engaged in a rather childish campaign of delay and malicious compliance in response to my freedom of information request for the internal draft of the infamous “gender draft guidance”.
1/🧵 Dame Cass seemingly made 1 concession in the Kite Trust Q&A after her RTC nonsense was obliterated: she now claims she wants “the community” to be involved to produce “high quality studies”.
Oh, then why didn't she engage “the community” during the four years?
The article by Sam Fowles is excellent. Glad lawyers are offering commentaries from a policy perspective.
I need to offer a correction tho. The Equality Act contains not just one, but numerous loopholes. As both a lawyer and engineer, I'm familiar with the Swiss cheese model.
1/🧵 Can I share
@wesstreeting
vile speech at Commons yesterday? 𝐁𝐨𝐥𝐝 mine.
“I thank the Secretary of State for advance sight of her statement and, even more importantly, Dr Hilary Cass and her team for the thoughtful and thorough way in which they have undertaken their work.
Dame Cass wanted to spend £650,000 on their data linkage paper. Yes, that's public money going towards unscrupulous conversion therapy promoters like Tilly Langton. Imagine how many children can have their health improved with this amount of cash?
Just had some awful bigotry posted through my door from
@SallyJamesPOW
- just imagine what someone transitioning will feel getting this shoved through their letterbox. Absolutely horrendous way to behave.
1/🧵 Sunshine is the best disinfectant outside medical settings.
I’m about to send some freedom of information requests in re the Cass review. What do you want to know? Let’s brainstorm.
The definition of an anti-trans hate crime according to
@cheshirepolice
is:
Any criminal offence which is perceived by the victim or any other person, to be motivated by hostility or prejudice against a person who is transgender or perceived to be transgender.
16/ Some commentators have pointed out the review arbitrarily excluded research less than 2 years old.
I suspect the reason maybe the proportion of trans men seeking gender affirming care has dropped and stabilised. Latest studies undermine these charts.
This is inaccurate. The original common law position supports self-identification for all purposes except marriages and registration concerning the individual. Corbett modified it (only in the UK). This is reflected in the minimalistic drafting of the Gender Recognition Act 2004.
1/ wtf is it those GC™ lawyers and laypersons asserting“transgender identity” is not a protected characteristic? “transgender identity” under the English and Welsh Sentencing Code and the prospective Scottish hate speech offence is a protected characteristic and…
Correct and it’s already banned in England too. If I see this arrangement of flags in public places, I will report it and press very hard for prosecution. Again, these are not even edge cases.
My view on the Cass review:
It is flawed. Dr Cass should withdraw her interim report and resign. She should acknowledge she is not up for the job. She does not have necessary skills, experience, or qualities to repel the political interference. (1/2)
15/ And Dame Cass calls for “exploration” of porn consumption during conversion therapies. This is under the sections “Growing up in the 2000s: generational beliefs and gender identity, online stressors and harm”. Oh, gender ideology.
Brianna’s close friend letter is read. How the first time Brianna was invited over and she spilled blue nail polish on the newly installed kitchen countertop.
We sing Somewhere over the Rainbow.🌈
1/🧵 Critique of the Cass spin-off papers
Given the main Cass review has been thoroughly discredited, I'm starting a new thread specifically to address the spin-off papers, which are also of poor quality. It might take me weeks so feel free to retweet whenever I add a new tweet.
Headteacher at Brianna’s school recounts their relationship at school, reminds us of her wittiness, how she admire her TikTok fame. “Be true to your self, be yourself.” (4/…)
The community reporter for Warrington Guardian recounts his first meeting with Esther Ghey, Brianna’s mother, give updates on the charity campaign. (2/…)
12/ It also explains the £650k price tag. They intended to spend approximately £100k per month to rush it through. That’s hefty rewards for an election/culture war/hate campaign isn’t it?
Dame Cass wanted to spend £650,000 on their data linkage paper. Yes, that's public money going towards unscrupulous conversion therapy promoters like Tilly Langton. Imagine how many children can have their health improved with this amount of cash?
A letter of Brianna school friend has been read, remembering the days they spent together on Minecraft and how Brianna built a large house with vivid details next to their cottage.
We sing Somewhere Only We Know by Keane.
(6/…)
There is a seemingly profound and uncontroversial assertion in Dame Cass's report that NHS “works in an evidence-based way”. Yet I can't find any evidence of such policy.
No, the NHS does not work exclusively in an evidence-based way. Stop throwing unserious buzzwords around.
Michael Foran has been spreading bizarre disinformation, providing commentary on recent court cases that is the polar opposite of the actual judgments. The German state court is his latest victim.
1/🧵 Why does Dame Cass repeat the false claim that the main Cass review did not discard all but a small portion of available medical research? It seems she is on a pathological liar pathway.
Why did Dame Cass want the data on short notice? I believe I'm asking the right question. This could be the most undeniable indication of political interference.
7/ Another point of unlawfulness is the demonstrably inadequate opt-out period of 3 months. I doubt it will withstand judicial review.
Who proposed it, and when? Is it about getting it out before the general election? I should make a freedom of information request.
The Higher Regional Court of Cologne held that the minuscule distinction between Holocaust denial and Nazi crime denial aren’t relevant and the appeal failed. Everyone understands that colloquially Holocaust denial includes Nazi crime denial.
9/ I guess I've found the answer without needing to resort to freedom of information requests.
The next GE must be held no later than 28 January 2025.
They literally aimed for a disinformation campaign during the election.
So, yes, it is a priority of the government of the day to take away the rights and liberties of transgender pupils and schools. The minister literally couldn’t wait. /7
The court confirmed the findings of fact of the lower court. The bigoted biologist sought court order to silence human rights activists. She failed, appealed, and failed again.
10/ Had Dame Cass, Langton, et al. not been stopped by the heroes at the GICs, we would have heard unhinged statistics and stories leaked from the Cass review over the next several months.
The court held that her original tweets, whether viewed in isolation or in response to an article, amounted to a denial of Nazi crimes.
The student bodies were allowed to use the
#MarieLeugnetNSVerbrechen
hashtag.
The gravest flaw of the Cass review remains its unexplained evidentiary standard. Yes, you can choose to exclude evidence, but you need to justify it.
Science is about showing your work, isn't it? Where is the justification? Where is the discussion? Show me.
@jk_rowling
repeatedly calls for unlawful discrimination against trans people. No one should ever do business with her.
Feel free to take me to the court too and I will prove it.
@jk_rowling
You are insane. Nobody supports putting violent men in with women. Making shit up. What’s with the phrase “trans identified male”, JKR? Your goal is to dehumanise the trans population - kids and adults - and have us stripped of legal recognition. Please take me to court someday.
In 2014, a pub denied a trans woman access to appropriate toilet. She complained and got unlawfully kicked out. It resulted in £1,500 damages.
Ali was briefly denied the right to respond. He was, lawfully, not reinstated. The initial hiccup resulted in £9,100 damage.
I’m sorry?
I have selected 9 revisions on the list for publication. The DfE must promptly comply. I’m fully prepared for reviews, appeals, and further proceedings. I don’t think they will do the right thing, but let’s see. 8/8 END
The Cass review is a low-quality piece of original research (primary source).
It’s disgustingly vague how the host worded his questions. He should not brand it as “valid scientific document”.
Great answers from
@patrickharvie
💚 I'm confident we can turn it around and get the pause on puberty blockers lifted in Scotland.
Please email your MSPs. Urge them to ask NHSGGC to rethink their decision to pause puberty blockers. MSP emails found here.
🧵The Guardian
@helenpidd
’s piece is wrong. An unnamed member of the legal profession (in my opinion, maliciously) reported
@JolyonMaugham
’s tweet to the clerk. The prosecution did not complain about it.
The judge said she didn’t want to make a determination. (1/4)
