This approach does not work.
DfE are just continuing an inherited regime.
All children have a right to education, parents do not have a responsibility to place their child in an environment of mental or physical harm for the sake of statisticians and a system on its knees.
I make no apologies for saying the best place for children is in school.
The Tories tinkered around the edges of a generational challenge. Labour are gripping it.
This week must be back-to-school week, not just for some children, but for all children.
As a family lawyer you get to hear a lot of brilliant children’s names.

Today, months after proceedings concluded, I received a photo of them together on their first family holiday.
With the right support all parents can parent.

No increase in fees and thus wages, after 30 years - same hours, in worse conditions, all for the benefit of vulnerable people.
If I had a kid, and they came home from school and told me this happened, whether they got an ice cream or not, I would take my kid out of that school.
It is very likely that the data they will compile on your kids attendance will be kept on record for years after they turn 18.
Kids don’t need a truancy database, spend all that money on making schools inclusive and safe spaces for them to want to attend.

Let’s put 84 extremely damaged and likely abused children into a nearly 200 year old prison where they will be locked up for months/years in appalling conditions.
It is not rocket science why this system is not working.😫
Feltham child prison now described as "most violent prison in the country".
Of 84 children imprisoned there at time of inspection, 51 had been in care.
22% of all children too scared to make a complaint.
2 children locked in their cells for 100 days.

As with most things in this country the argument is the wrong way around.
SEND kids are not a problem to be solved.
The problem to be solved is how we have allowed the privatisation of essential services to the point that private provision can charge whatever they like.
Cllr Hammersley responds to being told that children with SEND were institutionalised with "they must have had better ways of dealing with them. Let's go back to some of those ways"
Today is the first time in my career, a severely disabled client is going home with their child under a final order.
This was the result of months of hard work from my client and their family.
If only they all ended like this.
Being a legal aid lawyer is basically having to tell someone some of the best/worst news of their life then being paid £3.69 for the call 2 years later.

As bleak as this job can be at this time of year, finding out a client who spent Xmas in a very dark place last year, will have their children back for Xmas, and have just cleared their rent arrears, is a very good way to start the day 💫
Today in private children’s law: an email at 8.15am from a solicitor marked URGENT!!… the subject is arrangements for an after school club.
As a profession we need to stop letting our clients set the tone of correspondence.
So both my current paralegal and previous paralegal got calls today. 🤩
Goes to show if you can suffer me for 6-12 months you have a lifetime at the bar as a reward 😏

I was recently interviewed about being a legal aid lawyer and I made the observation that being under 35 in this sector is becoming increasingly rare.
Without future legal aid lawyers there is no future in the rule of law.
Really tired of seeing my clients described by professionals as “unskilled or low skilled” because they work in hospitality or retail.
I learnt more transferable skills for my job as a lawyer working behind a bar, than I ever did in law school.
It’s wild that as a new mum you can be kept in a hospital after you are fit for discharge, under no legal framework, simply because the solicitor at the LA is on annual leave 🫠
What is the point of legal rights if the system requires you to compromise them because they are too expensive to litigate? (I had similar thoughts when I read this case about an aborted cruise through the Northwest passage)

I always see housing as my client’s main issue. MH struggles, domestic abuse and alcohol and substance dependencies often stem from poor or precarious housing.
But instead of sorting housing issues we spend £££ on care proceedings, foster placements and MBUs.
Calls for a royal commission on social housing. Such is the shocking state of provision, a commission of this kind (improbable under current Government) last set up in 1884! In so many respects, our society has been driven back to Victorian conditions.

It’s wild we have spent months talking about VAT on schools that provide education to under 6% of the country
Yet the SEND crisis is not on every front page and every party election leaflet.
This echoes so much of what I'm working with every day. Every election candidate needs to be questioned about what their party will do about the growing disaster in SEND education.
Just because my client is in prison doesn’t mean they and their family lawyer should not be put on notice of an application by an LA to take their children into care.

There are currently no perinatal Mother and Baby Units in London.
London mothers in the midst of a mental health crisis while pregnant will now be far more likely to have their children removed at birth as there is nowhere to safely care for their baby.
Parents are getting prosecuted via the single justice procedure for struggling to get their kids to school.
Most never respond to the notice.
I wonder how many miss the post due to multiple moves in temporary accommodation 🤔

Investigates - Britain’s hidden homeless children
Nearly 140,000 kids in Britain are now homeless, in so-called “temporary accommodation”. We went to a school where half of the kids don’t have a home to call their own.
It is a strange part of my job that sometimes I am present in the hospital on the day of a client’s child being born.
Often the circumstances are very difficult.
I’m always reminded of John Berger’s words “Every child begins the world again.” 🙏
From the 15th April all judges at the CFC will be robed as part of a 3 month pilot to see if it improves litigants behaviour! 👩⚖️
Practitioners don’t have to robe tho so my dreams of wearing a cape to work are in tatters 🧛

Acting for a YP in DOLs proceedings was one the hardest thing I have ever done.
My client is the most incredible and resilient YP I have ever met.
The trauma inflicted, professional incompetence and criminalisation of our young people is a national disgrace.
Young people subject to Deprivation of Liberty Orders speak out… talking of inappropriate restraint, isolation from family and friends, long term impact on their lives.
Well I didn’t win most stylish solicitor 2023. 😝
But at least I showed up…and met some incredibly stylish lawyers! 🤩

I was told yesterday at CFC that they need 50% more SWs and a s.7 will now take 28 weeks.😫

One part of the MH system I will never understand is that people who are feeling mentally unwell are being reported to the police by crisis teams.

Trauma informed support is great, but we also need a functioning welfare state to support parents after their child is removed, instead of the loss of their child leading to the loss of societal support.
What greater harm can the state do to a person?

It’s wild that it’s not a bigger news story that one of the largest LAs in Greater London went to the SC and said they can not afford to provide accommodation to a disabled person and their family.
Judgment has been handed down this morning in the matter of R (on the application of Imam) (Respondent) v London Borough of Croydon (Appellant) UKSC 2022/0102:
It will never not be bizarre for an LA to rely on a parent being care experienced, as threshold in proceedings where they are seeking to take children into care. 😑
“What has happened here is shocking and disgraceful on so many levels.”

So rotten for LAs issue proceedings on the last days of the year.
It means parents and their lawyers are spending Christmas preparing a case instead of taking a break. Scrooge-like behaviour!
Everyone knows spending millions £££ locking up very vulnerable kids in airbnbs is vile and wrong, but it is the end point of a social care system which has been cut to shreds and is not fit for purpose.
Maybe as a society, we should simply not refer to people who murder their wives and children, as husbands and fathers.
Murderer is a more appropriate title.

Adult social care seems to be weeks of Teams meetings about something for a client.
Only for a manager to say “that’s not our job” at the end of it all.😒
The no recitals allowed rule at CFC is frustrating as recitals allow parents to feel like they were heard even if the order is something they could never agree to.
Recitals are a useful tool (if sometimes abused tool) and a blanket ban is a shame.
