It's with great apprehension (tbh) that I share Terrell Carter's and my latest, If the Subaltern Could Speak, the second in a series which develops the theory and practice of Participatory Law Scholarship.

Lots of great commentary on this, but one thing I haven't seen noted is that South Africa is following the same procedural posture as Ukraine against Russia, requesting provisional measures under the Genocide Convention which the ICJ ordered last March.
A 🧵 for IL newbies
My family is trying to get my nephew to call my dad “Papa Doc” (he’s the town doctor) and the human rights lawyer in me is dying inside but I don’t have the heart to tell them.
Today feels like a big day. After months of work, we're rolling out our latest project on "participatory law scholarship," which is legal scholarship co-authored with those with no formal legal training, but expertise in law's injustice through lived experience.

Excuse me while I disqualify myself from ever working at the ICC, but I hope that you will read and consider my latest:

I’m so excited to join this dynamic and generous faculty though I will sorely miss my dear colleagues

It is with great anticipation, and quite honestly a little bit of trepidation, that I share "Unentitled, The Power of Designation in the Legal Academy," a forthcoming essay in
@RutgersLRev
that a well-meaning mentor advised me not to write. 🧵
Now
@SSRN
Learning the hard way that my very existence in the legal academy is confusing/unsettling for some, which is a place of rigid binaries (clinical/podium, advocacy/scholarship, practice/theory). But I've always inhabited the borderlands and honestly that's my strength.
My co-authors (Rell Carter & Ghani Songster) and I are so happy to share that Redeeming Justice, has found a home
@NwULRev
. In our article, we argue that all humans have a right to redemption, which is embedded in the 8th Amendment through the latent concept of human dignity. 1/
Received word yesterday that it's Twitterable news:
Giddy to share that I'll be a Fellow in Law

A brief thread 🧵
The hierarchy in the legal academy is so ingrained in some people’s minds that they don’t even realize how ridiculous they sound to those of us who don’t believe in it.
Here the US will most certainly veto enforcement of any provision against Israel...
#ReformTheSecurityCouncil
That doesn't mean this case is not important, but I think that we need to be honest about the real flaws in the intl legal order that limit its effects. /End
How does it feel to be asked to co-author a textbook that you love with people you have long admired? Pretty darn good!

If I have any advice to give junior academics, it’s this:
Don’t waste your time trying to win the approval of those who others deem important. Instead focus your attention on those who give you energy and inspiration freely. They are the ones that make your career fulfilling!
As an accidental law prof, being called a scholar sometimes felt unfitting, so you can imagine what being named as an Inaugural Dean’s Research Fellow
@DrexelKline
alongside my superstar colleagues
@dsc250
&
@tabathaabuelhaj
means to me. 🥰
@unruly_curry
Can you put them in touch with me? I have a ton of great shots to share with them and the press wants the video but I want their permission first!
What a beautiful day for making history! Congratulations to Arianna Freeman on her investiture to the 3rd Circuit today-the first woman of color in that role! Not a dry eye in the place!
After two painful weeks of writing nearly every minute of my spare time, I now have a document with 8,000 words that loosely resembles the form of a law review article. That's not nothing.
Looking for inspiration: Can you share a law review article that you actually enjoyed reading? Not in a utilitarian way but rather in “I can’t put this down” sorta way. Maybe I am asking for too much from legal scholarship.
This is the hardest piece I’ve ever written, so it’s uniquely fulfilling to know that it’s officially out in the world. I can’t express my gratitude enough to the editors of
@ColumLRev
for all the time, energy, and joy they put into this project. Thank you!
In “Participatory Law Scholarship,” Rachel López (
@Rachel_E_Lopez

Hot off the press! We just filed a momentous complaint against US’s use of life w/out parole sentences. Don’t know what to say except that the mission of the Right to Redemption Committee is being realized. Being a part of this has been life-changing.
Since I missed the awards ceremony because I was at a conference, I decided to take today to celebrate winning my university's award for civic engagement.
When I first learned about the award, I immediately thought of all the other people who should have won it alongside me. 1/
Even when the law review submission process is going well, it still feels bad. I worry about the message it sends to our law students. The whole "trading up" expedite process seems totally demoralizing, re-enforcing hierarchy in the legal academy and gamesmanship. It bothers me.
It's been harder than I imagined to teach crim law again without even a week's break btw spring and summer terms. So winning this Teaching Award gave me a needed jolt of energy & affirmation that my critical approach to curriculum design, described in the 🧵below, is resonating.

A brief🧵
Like the Gambia, South Africa is not claiming that Israel committed genocide in its territory, but rather that as a party to the Genocide Convention, it has the power to file this petition at the ICJ because of its community interest in preventing genocide (simply put) 3/
Just realized that in the last couple of weeks, I read & commented 3 books & 4 papers, chaired two panels, presented on two others, moved across two continents, and had probably the most important interview of my life. Will someone, anybody, please clap? 👏👏👏 It's been a time.
Please feel free to hate *like* this post but somehow I stumbled onto this being my home “office” for the next two days.
It feels unjust but if you knew the year I’ve had… well, maybe the universe is just making amends.
Just found out that my sister, a nurse at a hospital in South Dakota, got vaccinated last night. My dad who has continued to see patients some with COVID despite being at risk will be among the first in New Mexico. And can confirm crying from relief is definitely a thing. 😭
Still pinching myself in disbelief that
@VirginiaLawRev
hosted an entire symposium focused on Participatory Law Scholarship... honestly, never even dreamed that it would be possible...
Thank you
@UVALaw
for reminding me of that wonderful day and amplifying this panel!
As a kid and then college student, I always hated that my birthday was at this time of year, because it meant I was too busy studying for finals to celebrate. But today both marks my birthday and the last day of the semester, and boy have I earned this celebration.
A VERY prominent law professor in my field advised me that my focus on transitional justice in Guatemala was too narrow, saying “I mean, isn’t it the size of Connecticut?”
Spoiler alert: It’s not and I am now writing a book on the subject.
I received some really good professional news today, but I am feeling a bit of whip lash between professional highs and personal/global lows. It’s hard to be joyous when you know others are hurting so much.
This is goosebumps material, but it happened today. My co-author will likely be released tomorrow at the same time that Ghani and I are receiving the LSA Article Prize for our joint article, Redeeming Justice.
Just have to put this out into the world.
You know what would make winning this award really special: If Governor Tom Wolf signed our co-author Terrell Carter's commutation, which is already on his desk, in time for him to be free by the date of the award ceremony on July 15th!

As some of you know, I am teaching crim law for the first time this semester and next week we’ll cover sexual assault. I am hoping that others might be willing to share any resources about how to teach this topic in a trauma informed way.
Really feeling the joy of this transition as I have been invited to attend not one, but two international law events this week, and then another one next week
@TempleLaw

Rachel López practices in the areas of criminal law, public international law, international human rights law, international criminal law, and post-conflict & transitional justice.
We are delighted to welcome Prof.
@Rachel_E_Lopez
to Temple Law!
Just like with Ukraine's petition, the enforcement of ICJ decisions, both preliminary decisions and
those on the merits, rests with the Security Council. I write more about that problem here on p.7:
Spoil alert: Russia has veto power, but here... 5/
Sometimes it is easy to feel like your work doesn't matter... like it's just a tiny drop in an ocean, but today I got an email letting me know that a project I worked on in 2016 could positively impact 15,000 Philadelphians and I'm on cloud 9. Just keep plugging along folks!
A few exchanges w/ very senior scholars have left me so saddened about the state of academia. How you can reach retirement, & in one case, the height of the profession, but still be concerned w/ bean counting top placements & citations? Someone shake me if I ever end up there.
Yesterday, for the 1st time, I participated in an academic workshop in Spanish. It felt like such a triumph. This almost feels too personal to share but I thought some might be wondering why someone with my last name would be so thrilled to be told her Spanish is good.

This is also the same procedural posture used by the Gambia against Myanmar in their petition for provisional measures under the Genocide Convention in 2019. It was able to do so as under obligations erga omnes partes, which has significance for this case too.
At oral argument on Election Day, Justice Alito asked “Do you think that there are any human beings who are not capable of redemption?”
My co-authors and I tackle this critical question in our article, Redeeming Justice, now up

A colleague I hardly know reached out this morning to say he will be quoting my work at a conference Vienna today. It took him a few minutes, but my day is suddenly much better than it started. 🥰 🥰 🥰

Can you share any examples of legal scholars whose scholarship was implicitly informed by their life experiences, though they don't explicitly acknowledge it in their writing?
My co-author of Redeeming Justice

Terrell Carter just got all five votes from the PA Board of Pardons at his Merit Review Hearing. This is the first step in the road to a commutation of his LWOP sentence. I'm not crying, my whole clinic is 😭😭😭
Terrell Carter is a role model to many people inside and outside the walls. He is a poet, a public intellectual and a leader in the lifers group Right 2 Redemption. Recently he co-authored an article in

Of my research to date, this feels like the most meaningful and significant, mostly because I know what it means to my co-authors.
Our revised version is now up

In contrast to earlier case law,, the ICJ agreed that the Gambia had standing as a state party to the treaty, opening the door for this case.
Again for IL newbies, this is not criminal liability for state liability... but here's the snag... 4/

A brief 🧵about all of the incredible speakers!
You can register here:
I am so lucky to have a professional life full of incredible mentors who have really helped build my confidence, but I've now experienced a few who have done subtle things to punch me down. It's unsettling and I never know how to respond. Have others dealt with this/have advice?
So many things have happened in my professional life that I never expected, but this is one I never even imagined. I really wish that I could send this link to my grandma. I can almost hear her say, "hijita, I am so proud," as she did when we last spoke.
What an incredible day for redemption!
Wish I could be there but there is no better feeling than seeing the eyes of my co-authors together again but this time free.

I should be tweeting up a storm to amplify my co-authors' and my unwavering belief in the right to redemption but this decision is so gut-wrenching...why are we so unforgiving...so committed to eternal damnation for kids? I just can't. Signing off for the day.

Every time my current self feels the excitement of being asked to present at a conference, I wish my future self would remind me of the absolute dread of having to present at that conference.

My spouse comes back from a trip tonight so I’m frantically removing all evidence of how slovenly I lived while he was away to prove that I can live an adult life without him, though clearly I can’t.
When we wrote our 1st article, it was the heart of the pandemic. Rell was incarcerated, only allowed out of his cell for 15 min/a day when he would send his words out bit by bit via the DOC message portal.

I'm taking a hiatus from clinical teaching to devote more time to writing and will be teaching crim law for the 1st time next spring. Would be so grateful if folks, esp. those taking a non-traditional approach to the course, would be willing to share syllabi, exercises, and tips!
I used to think that innovation in scholarship meant raising an idea that no one had thought of before. Now almost a decade in, I think that it’s putting into words what many are thinking but haven’t yet said or bringing the work of others forward in a way that didn’t foresee.
I am not usually a “send thoughts and prayers” type of person but the next five days are going to be very scary back home and I got this picture of my uncle’s house last night, so send whatever works.
