Swami Vivekananda says in Karma Yoga - "A man must go about his duties without taking notice of the sneers and the ridicule of the world." And definitely not by those who have neither read nor understood the words of the venerable 1Oth guru who stood for justice and piety!!
@Luthra_Sidharth
We had a great day and delighted to meet you at the BAR COUNCIL OF INDIA CONFERENCE..Your smile spoke a thousand volumes sir..๐๐ป

Proportional representation based on population is important, but states and UT's that have effectively controlled population growth, have to be treated fairly in representation in Legislative bodies. And those which failed cannot be rewarded with greater representation.
Today was asked to appear on a TV show on the Shardha murder case by a NOISY prime time channel. Though I reluctantly agreed I am now told the 'angle' is changed to 'love jihad' so am out of it. It's tragic death - let's not use it every which way we can for TRP's.
Back from Hyderabad with its clear blue skies yesterday. As we flew into Delhi, seems other than waiting for divine intervention by Indra Bhagwan, (and focus on upcoming elections), our elected masters aren't even trying to de pollute the great North Indian winter smoke house.
Sitting in an Indigo flight at Dehradun tarmac for over an hour, waiting to take off for Delhi. Tempted to get off and head to the beautiful hills which I can see from the window!
For young lawyers who start afresh, there is a world beyond SC and HC. And that's trial courts where there are maximum opportunities to independently appear and do trials. That's where a lawyer's foundational understanding is made. Our law schools need to focus on this.
Our Indian SC has in its judgement in Balaji Baliram Mupade [29.10.2020] written of the need for judicial discipline requires promptness in delivery of judgements
16 years ago this day, I was designated as a Senior Advocate by the Delhi HC.
I thank all the judges who (at the time) thought me fit to adorn the senior gown, and lawyers who supported me.
And my family and friends, with whose encouragement and support it was made possible.
Nowadays my daily prayer is that this Diwali, Delhi and NCR denizens abstain from crackers. And I really hope political leadership across parties lines will support ban on crackers.
Voters of South Delhi are wondering what led to yesterday's rant by their MP. His histrionics demonstrate a forgetfulness of the oath of office, disregard for the exalted status of the Chamber, and his solemn duty to be his electors voice in the temple of democracy!!!

The new Code (nyaya sanhita) introduced in Parliament today has the (inadvertent) impact on colloquial daily language terms, such as calling a person '420'. And perhaps a few more ...

Its ironical that hotels ask clients to save on linen/towel change which is essential, but continue to use multiple small plastic bottles of soap, shampoo, cream, conditioner etc. Such rampant plastic use doesn't make for a green hotel or a green planet!!!
As Court reopens one feels like a child whose vacations are over and its back to school. Except that as litigators there is an exam every day you are in court!!
With immense joy yesterday got tied a turban with a 'kulla' inherited from my late grandfather in typical West punjab tradition.
One the rare remnants of separation (in 1947) that our family was able to retain and have been able to preserve -an emotional connect to our past.
My grandfather's resettlement card post partition - memories of another Era- a stark reminder of the struggles of our elders whose hard work and untiring efforts ensured a better life for our generation and those to follow.
One is hearing whispers that lawyers appearing in sensitive cases are being liberally subjected to phone taps. If so, someone needs to ask how such a blatant breach of privacy, legal privilege, and curtailment of access of justice can be permitted.
Unusual and unprecedented for the SC Collegium to give such detailed reasons and responses to Government objections for elevation of Saurabh Kirpal. But then we are living in unprecedented times aren't we...
Driving to Chandigarh yesterday, I saw the never ending tragedy of how confused urban planning is alongside Highways - extraneous considerations at work. Fancy high rise development may look good but cannot be allowed to choke Highways - lifelines of the nation.
@NHAI_Official
Bollywood has near finished traditional Sangeet in Punjabi marriages beyond small towns.
Ladies sitting around a Dhol with the family and singing old Punjabi songs (passed through oral memory), generation to generation such as 'Kala doreya kunde naal.." needs to be saved!

Industry creates opportunity and jobs and is crucial to nation building. Must be allowed to achieve full potential without fear of reprisals and hindrance for expressing views. After all Art 19 - freedom of speech is a crucial fundamental right.
A mo(u)rning thought- Doesn't PMLA which empowers ED (central agency) over ride criminal law (state list) & breach federalism under the guise of treaty obligations. Policing, prosecution are state subjects.Retaining stolen property(S.411. IPC)is same as proceeds of crime (PMLA)!
Sitting in pub in England - a functioning Church (and graveyard next door), I see dignity of the church and the charm of the pub co-exist. When will we in India understand that sanctity of religious places come from spirituality within its devotees, not external manifestations.
From yesterday's recommendations it seems that Chief Justice Muralidhar of Orissa HC is unlikely to reach SC.
The silver lining is that we at the Bar are more than happy to have him back!
Always a learning experience to read Dr Sengupta's thought provoking works. Looking forward to reading his book, and then chatting with him about it (whenever he can spare the time)
My new book The Colonial Constitution is out today! I hope you enjoy reading it as much as I have enjoyed writing it. If it provokes some original thinking about our constitution, it will have served its purpose.
A short excerpt:
The Colonial Constitution is the story of why
While some of us (mainly lawyers) think the change in law Minister is a demotion, that's because for us the world view is law centric.
With an atmanirbhar Bharat outlook, Earth sciences is an important Ministry whose time is coming...
The successful rescue is a fascinating combination of innovative technology and Indian JUGAAD (use of rat hole miners). The result is laudable. And a time to innovate by diverting rat hole miners to legitimate work such as rescues and service of the nation.
"While the Nation celebrates Azadi Ka Amrit Mahotsav to commemorate 75 years of independence, officers who are enjoined with the duty to prevent crimes and ...protecting citizens... seem to be oblivious of the Fundamental Rights" SC in Ameena Begum's case decided on 4.9.2023!
Today appearing against CBI, I recalled -since 2013 CBI is operating under a stay order of SC after Gauhati HC held it to lack legal sanctity. On checking found case was last listed in 2019. And that's the state of our 'premier' investigation Agency!
The Sup Ct has acquitted 2 more

Om Prakash under life imprisonment was also acquitted.

Is the voter's right to a government headed by leadership of his/her choice in a representative democracy not negated, when the decision as to will be CM of a State is taken post election, and by the High Command of the successful political party. Don't voter's deserve better??
As elections come my wish list is -
1. Supporting and increasing funding of public education - school and University level
2. Creating Healthcare facilities at block level and municipality and/or providing private Healthcare support to establish facilities at such levels.
Interesting move by Punjab govt to start work at 730am. Maybe time for courts to consider starting at 830/9 am, and finishing earlier! In summer Rajasthan HC begins at 730 am. Should save electricity cost and travel time (avoiding traffic) though night owls won't like it!
Visited Aligarh Muslim University to give a lecture today and had a special tour of the residence of Sir Saiyad Ahmed Khan and the majestic Strachey Hall.
I am amazed at the silence on pollution levels. Are our elected representatives unaware of how bad it is out there. Or cosy in their hepa filtered homes?
To those who ask why I describe myself as a 'student of law', I say this - One is always a student!
The more one seeks to learn, the more one realises how little one knows!!
Give investigators vast powers, reverse burden of proof on accused, add the spice of restrictive conditions on bail, and flavour with accused statements being made admissible and reduce judicial oversight- what a recipe sirji.
On Saturday when my Indigo flight from Dehradun got delayed I must record and appreciate the grace, care and help offered by air crew and Capt Battish who engaged with every passenger. Thank you.
Cross any commercial street (in the night) to see glitzy bright signboards on even when shops are shut and the world sleeps. Isn't it a national waste?
Can't govts encourage establishments & shops to use solar for external lighting - reducing carbon emissions with clean energy.
Renaming Allahabad as Prayag is fine, but someone has forgotten to REPAIR and FIX the road to enter this city. An year (since I last visited) and still the entry road (coming from Varanasi) to Allahabad is dug up and an (unholy) mess -traffic snarls persist in night or day!
Sr Adv Luthra quotes from John Stuart Mill:
โIf all mankind minus one, were of one opinion, and only one person were of the contrary opinion, mankind would be no more justified in silencing that one person, than he, if he had the power, would be justified in silencing mankind.โ
A wise and seasoned political friend recently told me : never say anything which lets your opponent adorn the mantle 'bechaara' and become the object of voter's sympathy. It's political suicide!
Whenever H.E. the President makes such a public speech Excecutive action normally follows. Saw the excellent measures for poor prisoners earlier this year post her speech. Looking forward to these proposed changes which should however secure and ensure judicial independence!
Even 6 decades after Goa became part of India, the Penal Code provision on overseas abetment has an illustration treating Goa as foreign territory. When will the Law Ministry move to correct these archaic provisions???
Landed at London terminal 2 Heathrow at 630 am this morning! Most of the immigration desks were operational and clearancewas fast. And we got out so quick that we have to wait for our taxi. Well done Heathrow!!
For those fretting about the law Commission 'report' on sedition, I say don't worry- successive government's have not taken LC reports seriously ๐.
And not many lawyers read LC reports either, till a case comes up on the subject and one is paid to do so.
Every Sunday at 7 am, Sparsh Foundation feeds over 500 children of indigent persons and daily wagers near the Maruti factory in Gurugram a wholesome healthy meal hot early in the morning. Kudos to the Foundation and it's team.
With the SC judgement striking down electoral bonds, the unforeseen consequence would be an impetus on use of Cash (but only for those who have it) in the forthcoming elections.
An eternal optimist, I hope Government brings a transparent scheme taking cues from the SC decision.
Are we not becoming angrier? Reactive ? Virulent and violent? Is this the world we want our children to inherit?? Can't just blame social media. Or those spreading hate and instigate hate crime.
Till realisation comes, our institutions must act to secure life, liberty, humanity!
"Registration of FIR and arrest of an accused are 2 different things. It is not correct to say that just because FIR is registered., the accused can be arrested immediately" para 109 - Lalita Kumari [2014] SC Constitution Bench. Yet arrest and elongated custody is the norm...
The timing of the 3 criminal law bills, to shed colonial legacy, in the 75th year of independence, with 15th August around the corner - not a coincidence is it?
Brrr......That we have a cold wave in Delhi is obvious from the fact that right now - 1 am Delhi is 8 Celsius and Mussoorie is 9 Celsius (altitude difference 6000 + feet)
By weaponizing liberty restrictive laws and agencies, have we not negated the right to liberty. What happened to the presumption of innocence which ought to define our criminal justice administration??
Firing in Tis Hazari Courts (today) is completely unacceptable for members of the legal profession. Action by BCI (Bar Council) though swift, must not end here. A deeper look at this malaise is needed to prevent repetition across India.
