Although not my area of expertise... if the decisions to get rid of public health measures were made by Dr Hinshaw, as suggested by Shandro yesterday, might that mean that the evidence underlying those decisions isn't protected by cabinet confidence and is thus FOIPable?

I'm sure they would claim it was, but if it truly was her decision then there is at least an argument to be made that it wasn't advice that she was giving them but rather informing them of her decision.

Cabinet privilege is a slick and slippery concept. It exists where cabinet minister says it does essentially. Courts previously have given cabinets wide latitude in deciding what is and what is not a cabinet doc or secret.
