A fair question to ask. On one hand, we want to retain the brilliance of the founders; and, on the other, we don't want legislation from the bench; however, the job of the Congress is to create laws; the job of the Judiciary is to interpret them in framework of the constitution

And, it was the Continental Congress under the Articles of Confederation during most of the 1770-1780s.
