Tillman not accurate there. Nominee did not say she “didn’t know”, she said she is yet to be a judge and so has never had any law clerks yet.

He's not allowed to ask that? Is it implicit that everything that's said in a confirmation hearing is part of deciding whether to confirm a nominee?

I may be off base here.. but shouldn't she not know? isn't it against a law (I think it's called Title VII) to ask prospective employees about their sexual orientation??

What Booker actually asked her: "Have you ever had any LGBTQ law clerks?"
Rao's reply: "Senator, I've yet to be a judge. I don't have law clerks."
So it was not as Tillman describes it, just a question about "staff" in general. It was Booker embarrassing himself yet again.

I don’t know is the perfect answer. LGBT or Heterosexual status should be irrelevant and considered extremely personal information. This is a line of questioning HR should be alerted to.
