Definitely not a religious test for office, though.

@cjscalia @MZHemingway Tillman not accurate there. Nominee did not say she “didn’t know”, she said she is yet to be a judge and so has never had any law clerks yet.

@cjscalia To be fair, Booker will be asked if he has had a gay affair. He will then pretend to be offended by the question.

@cjscalia He's not allowed to ask that? Is it implicit that everything that's said in a confirmation hearing is part of deciding whether to confirm a nominee?

@cjscalia didn't Booker ask if she had any LBGT clerks. She stated she hadn't been a Judge yet so she hasn't had any clerks.

@cjscalia @MZHemingway I may be off base here.. but shouldn't she not know? isn't it against a law (I think it's called Title VII) to ask prospective employees about their sexual orientation??

@cjscalia @MZHemingway What Booker actually asked her: "Have you ever had any LGBTQ law clerks?" Rao's reply: "Senator, I've yet to be a judge. I don't have law clerks." So it was not as Tillman describes it, just a question about "staff" in general. It was Booker embarrassing himself yet again.

@cjscalia She should have said, "If you met someone in a public restroom for the purposes of sexual contact, that would be immoral."

@cjscalia @MZHemingway I don’t know is the perfect answer. LGBT or Heterosexual status should be irrelevant and considered extremely personal information. This is a line of questioning HR should be alerted to.

@cjscalia What the idiot Booker doesn't seem to get is that that's not information that she should concern herself with.

@cjscalia Can you imagine a Republican asking questions like this of any nominee and not being roundly condemned?

@cjscalia @MZHemingway I wonder if @ZoeTillman knows how stupid her tweet is? I’ve never asked anyone if they were gay or transsexual or anything else when hiring. It is totally irrelevant just like Rao said.

@cjscalia I find it fascinating that a Senator is asking a question that it is illegal for an employer to ask when hiring someone.
