My client was just acquitted of sexual assault following a trial in the Ontario Superior Court of Justice. The judge found beyond a reasonable doubt that my client DID NOT sexually assault the complainant. I would not trade being a defence lawyer for anything in the world.

I cannot believe how many defence lawyers are becoming Crowns lately. A strong defence bar is vital to the functioning of the justice system. A weakened, inexperienced, beleaguered defence bar is not a sign of a justice system that is working.
My client was released today after a 4 day bail hearing in Lindsay. I will be paid for 2 hours of my time on Legal Aid. I did it because I so badly want the system to work. Gutting Legal Aid is the way to ensure people rot in jail. That is the real objective of gutting Legal Aid.

Most criminal lawyers would make more money if we refused to take Legal Aid. We take Legal Aid because we believe that every person charged has the right to a good defence and so badly want to fulfill that role. The cuts to Legal Aid are an attack on that idea.

I was very disappointed to read about politicians, yet again, weighing in on the appropriateness of Justice Copeland’s decision to grant bail to the accused who is charged with first degree murder of Officer Jeffrey Northup. A criminal case is not a political issue. Keep out.
Doing a bail hearing today for a client in custody at the Central East Correctional Centre in Lindsay remotely in my car. It is especially difficult for me to predict how this is going to go because I rely in bail hearings so much on my good looks.

There is something VERY strange going on. It’s not just that their actions are not in line with what they preach. It is that their actions are not in line with the presence of a deadly virus.
I have never had so many cases of domestic assault since I started practicing. For many of these cases, I am also seeing marriages and families implode. If you have managed to keep your marriage and family together throughout this time period, you should be feeling very grateful.

My client was just acquitted of dangerous driving, failure to remain at the scene of an accident and failure to provide a breath sample after a four-day Zoom trial at Old City Hall. I never get tired of hearing the words NOT GUILTY.
To me, the strangest aspect of the minimum wage for articling debate is that the law schools escape without a mention as if they bear no responsibility for this state of affairs.

is very unfortunate. It is simply not true that most of the offenders will ever be released. But crushing any hope of release violates the Charter. The Court has spoken. We are a nation and a people of laws.
I do not understand how the threshold for disclosure of public sector employees is still $100,000, the same since it began in 1996. $100,000 is not what it used to be. Accounting for inflation, it would be $180,000, which would be a much more suitable threshold.
I hope more law students who are in massive debt entering a terrible job market will come around to my point that the “wellness” movement is a complete con. The last thing a student needs is a wellness counselor telling them how to breathe as they move back in with their parents.
I found out yesterday that the person who interviewed me for my first job in criminal defence and gave me a shot passed away. I feel very sad that I did not get to say goodbye. If I had the chance I would have said thank you. That first job meant so much to me and so did he.
My client just pled guilty to the offence of careless driving under the HTA and had his charges of impaired driving and over 80 withdrawn. The best three two-word terms when practicing criminal defence are (in order): 1) not guilty, 2) peace bond, 3) careless driving.
Today my in custody client at College Park told me there was no kosher food for lunch. Incensed, I hopped in a cab to King David and brought it back to him, but was told by officers that they do in fact have kosher sandwiches and he ate two of them. My clients often make me laugh
My client’s charges of possession for the purpose of trafficking and trafficking marijuana as part of a marijuana dispensary project were withdrawn in Superior Court today. Someone that posed absolutely no threat to anyone ever gets to live his life in peace.
Instead of making judges do sexual assault training, politicians should be made to do training to teach them that courts should be free of political interference, that a criminal trial is not a political issue and that weighing in on the correctness of a verdict is a disgrace.

My client’s trial for possession of a loaded, prohibited firearm was just declared a mistrial after the jury failed to reach a unanimous verdict after three days of deliberation. As I’ve always said in criminal defence, if you live to fight another day, you win.

As criminal lawyers running trials on serious charges (Crown and defence), we are the heavyweight boxers of lawyers. It is a very hard job. It is becoming harder and harder because of the opinions of golfers, bowlers and croquet players on how best to prepare for a fight.
I am in day 7 of a jury trial. Every evening is spent researching legal issues that come up and preparing for the next day in court. It is stressful and exhausting. It is the only life that I could live.
A return to the office is not a punishment for me. Going to the office forces me to get up in the morning, get ready and be disciplined. It allows me to speak to my colleagues. It gives me separation between my home life so that I can get work done. The net positive is huge.
My client was arrested tonight and sounded like she was in terrible shape. I have lost two clients to opioid addiction and can’t bear being a witness to its destructive power. It is a horrible addiction. It is a pandemic.
I am in court in Oshawa watching the video remands with an accused asking to speak to duty counsel. The JP told him he could speak for a short time because of a busy list and lots of counsel who need to get out. The accused replied: “I need to get out too.”

People not involved in the criminal justice system cannot imagine what Parliament has done to sexual assault trials. It takes three days of court time to get judicial approval to ask the witness one or two questions.
I have not been able to speak to my client at the Central North Correctional Centre for four days. Please give people in jail who have are presumed innocent and stripped of almost everything better access to the phone.
