Art 771 says these are essential elements. Art. 772 says a serious and substantial failure to fulfil essential elements in Art. 771 allows the other party to terminate/suspend TCA. Just saying 3/3

@CSBarnard24 1. Does not the ECHR allow for nation states to exercise discretion when national security is at risk? 2. It was the UK judiciary that deemed Rwanda unsafe (also hence allowing asylum claims from Rwanda). 3. Why is Rwanda not even on the government’s Section 80AA list?
